DEMOCRAT AND CHRONICLE AUG. 17, 2000 A.M. DIGEST Lazio to swing through area U.S. Senate candidate Rick Lazio will visit the Rochester region tomorrow as part of a campaign swing through the state. Lazio, a Republican from Long Island, will be traveling on his "Mainstream Express" bus.

He is planning visits to Seneca Falls; Wayne County; County. His campaign Canandaigua; and Livingston Tuesday would not say specifically where he would be in those communities. Medical group plans meeting The Common Cause Medical Research Foundation, a Rochester-based nonprofit ACROSS THE STATE New York City Court upholds officer's penalty A federal appeals court yesterday upheld the 30-year prison term given the white police officer who claimed he was driven by "animal rage" to sodomize a black prisoner with a broken broomstick. A three-judge panel of the and U.S. Circuit Court of Appeals also said it had "no particular reason" to believe former police officer Justin Volpe when he said a fellow officer, Charles Schwarz, was not with him during the assault.

Schwarz denies he was involved and has appealed his conviction. The Aug. 9, 1997, attack occurred in a Brooklyn police station bathroom. Volpe had arrested Abner Louima when he mistook him for someone who punched his head as police broke up an unruly crowd outside a nightclub. Artists support museum strikers Strikers at the Museum of Modern Art drew support this week from celebrities, including artists Robert Rauschenberg and Art Spiegelman, filmmakers Steven Spielberg and Martin Scorsese, and performers Laurie Anderson and David Byrne.

The first strike in 27 years by museum employees including archivists, conservators, curators, librarians and other professionals has dragged on for more than three months. It's the longest strike in the museum's history, yet neither side seems willing to budge and each accuses the other of bargaining in bad faith. Points of contention include salaries as well as union demands for compulsory membership of professional staff. Carmel Woman arrested for phone theft A cleaning woman who was upset about breaking up with her boyfriend made $6,131 worth of phone calls to psychic hotlines from an employer's home, police said. She got plenty of relationship advice, they said, but no warning that she would soon be behind bars.

"That was the joke around here this week," said Detective Gerald Locascio of the Kent Police Department. "We asked her if the psychics told her we'd catch her, and she said no, but that she had a feeling we would." The woman, Patricia Ann Garofalo, 39, was charged Tuesday with two counts of fourth-degree grand larceny in the Kent Town Justice Court. Police said she used her employer's telephone and credit card numbers to make the calls over the last several months. She is being held in the Putnam County jail in Carmel with bail set at $5,000. West Point Cadet sentenced for breaking in A second West Point cadet has been sentenced to prison for breaking into a store at the academy and stealing nearly $25,000 worth of merchandise.

William L. Bender, 20, was sentenced to 15 months at Fort Leavenworth, dismissed from the Army and stripped of all pay and benefits. Riverhead Parolee gets death sentence A Suffolk County jury sen- group, will sponsor a conference this week on alternative therapies for and causes of chronic immune deficiency syndrome, Gulf War illness and related diseases. and 3 p.m., weather permit- ting. a tenced Nicholas McCoy to death by lethal injection yesterday for the fatal stabbing and sodomy of a supermarket co-worker while he was on parole for another killing. The jury decided on death after deliberating 15 hours over three days in the penalty phase of the case. Last month, it convicted McCoy of first-degree murder for the Oct. 31, 1998, killing of Victoria Peymann, a 33-year-old mother of two young children who had taken a night job to earn money for Christmas presents.

McCoy remained calm and looked around the courtroom when the verdict was announced. Suffolk County Judge Louis Ohlig signed the death warrant from the bench. McCoy will be taken to death row at Clinton Correctional Facility. "From the outset we believed the proof in his case was overwhelming," said Suffolk District Attorney James Catterson. "In the face of a vigorous defense, the jury confirmed this was an exceptionally strong case that demanded death."
