A state attorney questioned Massachusetts Institute of Technology economics professor Peter Temin's methods and calculations as the fourth week of testimony began before U.S.

District Judge Neal McCurn. In February, jurors awarded the Cayugas $36.9 million as the market value for 64,027 acres in Cayuga and Seneca counties illegally acquired by New York in 1795 and 1807. The annual rental value was set at $17,157. Temin, a witness for the Cayugas, compounded annual interest on that award based on the risk-free rate of U.S. Treasury bills from 1795 to 2000.

State Assistant Attorney General John Pickett asked whether Temin had subtracted expenses typically absorbed by landlords, such as insurance, or costs associated with investing, such as commissions. "I considered it as a jury award, not as a rent, not as an investment," Temin responded. Rather than one $30,000 cash payment for their land, the Cayugas in the 1700s opted for an everlasting $1,800 annuity or a 6 percent payment. Pickett asked Temin how many years since 1795 had the risk-free Treasury bill rate exceeded that. After checking his report, Temin answered: "Nineteen." "So, in the other 183 years, can you say Cayugas were better off with the $1,800 annuity than the $30,000 in cash?" said Pickett.
