Officer Anthony Sanchez, 31, was shot in the back of the neck during a gun battle with suspect Scott Schneiderman, said Lt. Steve Biegel, a police spokesman. He died at St. Vincent's Hospital.

Schneiderman was hit in the chest and forearm and was treated at Bellevue Hospital. He was released from the hospital and taken to the 13th Precinct for questioning. Mayor Rudolph Giuliani said District Attorney Robert Morgenthau should seek the death penalty. "An attack on a police officer is an attack on all of us," Giuliani said. The shooting took place about 12:30 a.m.

in a 10-story loft building on West 17th Street, next to the pricey Police clothing said the store 33-year-old Barney's. suspect had once worked for his father but had been fired for stealing from the business. The younger Schneiderman, who lives in Bayside, Queens, allegedly forced his way into his father's 10thfloor penthouse while wearing a mask. Police said the son used duct tape to tie up his father and his father's girlfriend. Dispute FROM PAGE 1B THE ASSOCIATED PRESS did not attack or provoke the police.

Henrietta resident Tony Kloch is not Native American, but was arrested at the Onondaga Reservation on Sunday while showing his support at the rally. Kloch said that none of the protesters had weapons, and they were demonstrating peacefully throughout the day. "It was bad," Kloch said. "There was never a dispersal order. They lined up like storm troopers and marched on the property swinging their batons at people." The disputes center on state efforts to tax alcohol and tobacco products sold at reservation stores to people who don't live on the reservations.

As a temporary measure, the Pataki administration asked the tribes to raise prices on their products to be more comparable with those of non-Native American merchants. Seven of the state's nine Native American nations now have agreed. The Senecas have been the most vociferous dissenters, saying such a deal would violate their sovereignty. The state has sought to block shipments of gasoline to the reservation beginning in early April. But on Thursday, a state Supreme Court justice in Buffalo ruled that the state had overstepped its authority in blocking shipments or forcing shippers to pay taxes on behalf of tribal stores.

The state filed an appeal of that ruling, and asked that enforcement of the judge's order be halted until the appeal was heard. On Friday a state Appellate Division judge refused to block the order. A spokesman for Gov. George Pataki said the state would not try to block any shipments while the case is awaiting the appeals hearing. "We're taking it on a day-to-day basis.

But we have an obligation and respect for the law," spokesman Michael McKeon said. a Sentence FROM PAGE 1B Ambrose admitted that they cided to rob Almansoob with a caliber handgun. John Brady stood lookout while Bashan Brady went into the store and shot Almansoob in the head, neck and chest. Both stole cash and food stamps as the grocer lay dying. Huether credited the brothers' arrest to police Officer Thomas Rutherford, who went to their home because he believed they might be involved.

Both later confessed. Both brothers told investigators that they talked the night before the robbery about needing money and decided to rob the store with a revolver Bashan Brady obtained from a cocaine addict. Bashan Brady had claimed that he shot Almansoob in self when the grocer tried to throw him out of the store, but he disavowed self-defense during the plea. As she imposed sentence, Marks said the case troubled her because of the availability of illegal weapons and drugs that were found in the brothers' bedroom and the slaying of a Yemeni immigrant who came here in search of a better life. "This sentence isn't going to do anything to change this," she said.
