Warney's lawyers said he falsely confessed because he is mentally ill and mentally retarded. Warney, 34, of 705 South goes to trial July 15 on two counts of second-degree murder intentional murder and murder committed during a robbery. Silvers, O.V. builder Octave Chanute, the craft that will be flown at Geneseo is a jet-age replica designed and assembled from carbon fiber, aluminum and other modern materials as a year-long project by mechanical engineering students at Rochester Institute of Technology.

Chanute played "a crucial role" as an adviser to the Wright Brothers, according to Kevin Kochers-berger, RIT professor of mechanical engineering. Kochersberger suggested and oversaw the student glider project. The student-built Chanute is scheduled to make its maiden flight from the 1941 Historic Aircraft Group hangar adjacent to the National Warplane Museum off Route 63 near Route 20A on Saturday. The RIT Chanute also is scheduled to travel this summer to Gary, where the original Chanute craft had its maiden flight in 1896, and eventually go on display at the National Soaring Museum just west of Elmira, Chemung County, later this year. "These are the aircraft that made the world of aviation possible as we know it," said Wadsworth, an aviation buff, landowner and descendant of British royalty who were among the first settlers of the fertile Genesee Valley. More than a decade ago, Wads-worth pioneered the warplane museum in a hangar at the WWII British-style grass runway on his family's lands beside the Genesee River near the village of Geneseo. After a bitter, four-year dogfight over philosophy, policy and use of Wadsworth's land, the museum board moved their annual "Wings of Eagles" show to Batavia two years ago.

The board recently announced plans contingent on the approval of museum membership to relocate to the Corning-Elmi-ra Airport in Chemung County. Among other issues, Wadsworth said his breakaway Historic Aircraft Group opposed the museum board's increasing reliance on jets and other modern aircraft at the museum and at shows, which were intended to honor the flying machines that helped win wars against Germany and Japan. This year's History of Flight show in Geneseo will highlight the recently restored Yankee Lady, a B-17 bomber and former hangar-mate of the museum's Fuddy Buddy, along with a WWI German Fok-ker triplane, 1908 Curtis Silver Dart, P-51 Mustang and Russian AN-2 biplane. A military cargo parachute drop, hot air balloon rides and other events also are scheduled for the air show. Reaching back beyond the era of mechanized engines, the show also will include an aerial ballet of loops, circles and other dance-like maneuvers performed without an engine in a sailplane piloted by a former their mother for eight weeks, beginning June 22.

That decision has set off an interstate battle over jurisdiction in the case. Circuit Judge Michael Jones in Pensacola, ruled Wednesday that the children must return to Florida on June 22 for their summer visit.
