Important to the censor in his appraisal is how the costume compares with what the average intelligent American woman either wears today or does not consider objectionable. This was what made the Bikini bathing suit, previously rejected, acceptable in "Town Without Pity." It is becoming evident, in 1964, that Hollywood has learned that talent, not bookkeepers, will make the movies that can meet the challenges of this generation. 14. stolen from him, wanders into a brothel. But by 1962 censors had given a seal to "A Walk on the Wild Side," which dealt with a brothel and a madam who was a lesbian. Of particular importance in movie censorship is an over-all principle underlying the code "moral compensation." In other words, against sin must be balanced punishment or contrition. This is the point that has probably subjected the code and its censors to more ridicule over the years than any prohibition.

THE ISSUE of the validity of "moral compensation" was raised intelligently by Max E. Young-stein, then vice president of United Artists. He protested that "Butterfield 8" received a seal of approval but not "Never on Sunday." He claimed this was because in "Butterfied 8" the sinning heroine (Elizabeth Taylor) dies and in "Never on Sunday" the prostitute who refuses to work on Sundays (Melina Mercouri) does not die. Shurlock retorted that the heroine's death was not the reason the film had been accorded a seal. In "Butterfield 8," he pointed out, the prostitute had expressed deep remorse.

But in "Never on Sunday" she saw nothing wrong or sinful in her occupation. What cannot be pushed past the the censors with sion and that would be closer to American thought and behavior, drifted toward its old reliable solution more sex and in more stimulating form. The code provides that the "sanctity of marriage and the home shall be upheld" and that "no film shall imply that casual or promiscuous sex relationships are the accepted or common thing." It also says that while adultery and illicit sex are sometimes necessary for plot, they "shall not be explicitly treated, nor shall they be justified or made to seem right and permissible." Scenes of passion are intended for plot, not mere titillation, and must be "treated in such a manner as not to stimulate the baser emotions." As for rape, this should "never be made to seem right and permissible" and "never be more than suggested, and then only when essential to the plot." THE CODE also contains prohibitions against dances that suggest or represent sexual actions or emphasize indecent movement; against obscene words, gestures, references, songs or jokes; and against vulgar dialogue. In 1949 a seal was denied to the Italian movie "Bicycle Thief." After decades of creating travesties on sex, the American movie industry is trying to deal maturely with this explosive subject.

For Hollywood, this break with tradition is outright revolution and it has created confusion among movie-makers and censors alike. Producers have learned that the old sex patterns have lost audience appeal. Censors have realized that the mere words of the code are inadequate for judging the "adult" approach that seeks out themes of adultery, rape, homosexuality, abortion, prostitution, sadism and masochism. One of the most controversial issues in the new Hollywood concept of sex is homosexuality. At first there were just flirtations with the subject, as in "Cat on a Hot Tin Roof." Then, as pressure increased to permit treatment of this subject, the censorship code was changed.

The ban on homosexua lity was dropped. Perversion made the Hollywood big time as a prime inducement for inyone in the market as movie material. First, there was television, which cut its audience in half. Second, there was a postwar reaction similar to that which followed World War I. Moral values changed. Though churches boasted of increasing attendance, divorce, adultery and illegitimacy all increased at a staggering rate. THE MORAL TONE of earlier Hollywood movies was outmoded, lagging badly behind reality.
