The hearing, attended by some 35 interested taxpayers, was In charge of Russell Suter of Albany, executive engineer of the New York State Water Power and Control Commission.

It was called to place before the state for approval plans' of the village to construct an additional dam and reservoir. It is proposed to augment the present water supply, which is provided by a gravity system operated by the village's Municipal Commission. Questioned at length by Leo Rice, Rochester attorney and Falr-pnrt two proponents of the project, Dr. George S. Price nd Staniland Scarth, asserted they had been misquoted in previously published reports which stated that "no water shortage is In Immediate prospect." Doctor Price Is chairman of the Municipal Commission and Mr.

Scarth Is superintendent of the water and light plants. May Go To Court Mr. nice, who said he appeared cs in individual and as attorney for a group of Fairport taxpayers, strenuously objected to the proposed construction on the ground that it is not justified by public necessity. He argued that the pop illation of Falrport is decreasing and that present facilities are sufficient. Hint was given by Mr.

The waterworks officials claimed that consumption of water is increasing and that last December it reached a high point for one day of 1,000,000 gallons. Mr.

Rice said that the village board resolution wus. based on Article 224 of the general village law, instead of on Article f2S, and insisted that the matte1 rhoukl have been laid before the taxpayers as a whole. He denounced the village board for its failure to publish official accounts of its proceedings In the Kairport weekly. He said this constituted a "vicious omission" and resulted in the residents having no knowledge on which they might base petitions for a referendum. Police Ju'stice Raymond J.

Lee volunteered the information that the board's proceedings have not been published since April as an economy measure. Argument by Mr. Rice that the funds might better be used to pay village taxes and for other purposes was ruled out as Irrelevant. Although the Municipal Commission is authorized to spend at) high as J40.000 for the water extension, If the state approves, Doctor Price estimated the cost would be $28,883. Later James P.

Wells, engineer who drew up the plans for the proposed dam, testified that at present prices, It might be possible to build for as low as $23,000 to S24.000. Present dam prices, he said, are about half of the prices of 1923. when the present structure was built. Says Shortage Threatens On Jan. 16 this year, the water In the present reservoir was down approximately 20 feet and between JW and 30 million gallons were left in storage, Doctor Price said.

In his assertion that If the water had gone much lower a real shortage would have resulted, he was cor-raborated by Mr. Scarth and Gearge Caler, general foreman of the light and water plants. Mr. Scarth said. Last year's total consumption was the estimated at 139,800,000 gallons, but no figures were available for comparison.

The failure to have exact figures, it was said, was owing to the lack of a master meter attached to the main line. Mr. Suter will prepare a report and recommendation to the state commission, which will hand down a formal decision. ri'PILS WRITE ABOUT BURNS That 4,779 pupils in 60 schools took part in the annual contest In Edinburgh, Scotland, promoted to encourage the study of works of Robert Burns, have been announced by the district educational authorities.
