Kiamlners Hear asei Attorney Examiner! VV. A. Hill and John J. Crowley of the Interstate Commerce Commission heard the East Rochester coal rale case on June 10, 1927.

W. N. King of Cleveland was counsel for the New York Central Railroad and James Stlllwell of Pittsburgh was counsel for the Pennsylvania Railroad. Mr. Dow represented the Ksst Rochester Association and was assisted by Harry S.

Elkins, rate expert of Washington and his associate. Witnesses for the East Rochester Association were Frederick W. Burton, manager of the Transportation liu-reau of the Rochester Chamber of Commerce; Mr. Elkins, V. F.

Millard, Millard Coal Company; David T. Lawless, Lawless Hro'hers Paper Mills; Frank A. Norton, Lawless Brothers Paper Mills; Norman flteve, Despatch Coal Produce Company; J. 11, McLaughlin, Foster Armstrong Company; Yale Parce, East Rochester realtor and N. Munger, Rochester City Planning Adviaory Board staff.

In November, 1927, Examiner Crowley filed a report with the Interstate Commerce Commission recommending that East Rochester be given the Rochester bituminous roal rates and that the Communion find that they should not exceed the rates contemporaneously applied to Rochester. In July, 1928, the Interstate Commerce Commission gave Its decision, reversing the examiner, holding that the assailed bituminous rates from the Reynolds-vllle, Pittsburgh and Connellsvllln districts to East Rochester would for the future be unduly prcjudlcisl to Esst Rochester only when they exceeded the contemporaneous rates from the same districts to Rochester by. more than 12 cents per net ton. The carriers carried the Cnmmls- slon's decision into effoct and made the bituminous rates to East Rochester 12 cents higher than the Rochester rate. Mr, Dow promptly filed petition for if argument and re-before the entire Commission in consideration and reargued the case December, 1928.
