MOTORMAN KELLY CLEARED A Recommendation That Nets be Hung in Front of the Street Car3 as a Protection to Pedestrians Run Down by Them. Coroner Kleindienat held an inquest last evening in the mayor's office at the city hall in the case of Michael Purtell, the 0-year old son of John Purtell bf No.

Cypress street, who was run over and instantly killed at 5 o'clock la.sit Monday afternoon on South St, Paid street near Fly street by an electric car on the Monroe avenue line. The first witness called was Rev. John P. Stew-art, restor of St. Mary's Catholic Church, who testified to the face that the boy was a pupil of St.

Mary's ixiroehiai school, and in. company with the other pu pils had been at the Academy of Music in the afternoon amending a performance of the Fquine Paradox. Father Stewart said that he did not ee the accident himself tout bad been, told 'by lie v. Father Ange-lo, his assistant, that the meu ia charge of the car were not in any way to blame for the accident. The children were going home in a procession and were on the west side of South St.

l'aul street aud the rurtell boy left the proce-ssion and ran into the street to catch on a wagon that was going south. Something else attracted his attention and be stopped pur suing the wagou and ram upon, the car track just as the oar came dowu from the south. Mrs. Margaret Schaum, of No. 1GG Cham-plain street, testihed that she was on the oar when the boy was struck.

She heard th' moitormitai call to him to look out and saw the motor-man himself with the brake. She did not see the boy. Charles F. Lighthouse testified that he was in his oiliee at No. 70 South St.

Paul street when the accident occirred. He saw the children passing and saw Hie boy run. from the walk into the street. He heard tlii motorman call to the loy to get out of the way. The boy hesitated and then the car struck him down.

Samuel A. Mills, of No. S8 Charlotte street, testified that he was driving through South St. Paul street and saw the accident. There was a wagon ahead of me," said Mr.

It was impossible to save him. If he had been my own son I could not have saved his life, he was so near to the car when I discovered him." Dr. Ij. W. Roue testified that he was on the car when it struck the boy.

Dr. Rose said that the niotortnai had toen sounding the gong for j.nne time before the accident occurred. I was looking out of the wiiulow," said Dr. Rose, "and I did not see the boy on the track." Dr. Rose thought tlie motorman did everything he could to stop the car and avert the acci-den Patrick Call, the conductor of the car, testified that Motorman Kelly ran his car with great care and kept the gong ringing constantly.

The jury found that the boy was killed by car No. 307 on the Monroe avenue line and recommended that the Rochester Railway Company place nets on the front of its cars so that persons who may be struck by the cars may be kept from goins under the wheels.
