Eochksteb W'atkh Womi Cost We noticed some time since the action brought by tbe Union Trut Company of New the Kocbrster Water Works Company. At a sjeial term of the anpreme court a receiver was appointed in the person of John C. Birds-eye, of Brook vn. The order also recites the condition of the wooden pipea, part of which were placed in the trenches and then left ia-eovered, and the remainder equally endangered from the fact that no water baa been let into them; that in tlie course ot a few years, if left in iu present state, it will have rotted away that tbe pipe laid, seventeen miles, baa cost about $225,030, which will prove a dead losa nuless the property is at once put into the hands ot a competent person empowered to take such steps as may be necesf-ary in the premises. The order farther provides that the holders of tba bonds be required to advance such soma as may be necessary in preserving the wooden pipes, all moneys so raiaed to be expended under the order and direction of the court.

Accompanying the order ia a circular, the most important points of which we append aa showing what the intentions of tbe plaintiffs are. N'bw Tobi Cttt, Sept. 6. 187L The attention of the holders of -the bonds ef the Kocbester Water Works company, known as the gold bends, dated May 1st, 1K69, and which are sec a red by the mortgage given bv that company te the Union. Trust company of New Toi as trustee, dated May 1st.

136J, to secure 000. 00 of bonds, is called to the terma ot tbe accompanying order appelating a receiver of tbe property of tbe Kocbester Water Works Company, dtc Arc. Tbe order was obtained in the cause in which it is entitled, which waa brought to loreclose that mortgage. Before the bringing of that suit, another sail to foreclose the previous mortgage given to Mam ford Si Whitney, aa trustees, to secure the bonds known as tba currency bonds, come ot wbicb still remain ontsuxuiinc and unexchanged, had been commenced. Other suits were threatened, aud one suit had been commenced, against the Union Trust company to compel them to pro-teed to the foreclosure of the mortgage given to them.

Ihe facta concerning the present condition of tbe Kocbester Water vYork Company are stated in the first part of tbe foregoing order. From these tacts it will be obvious that; unless the line of supply pipes of the company which is of wood aud has been laid at si ex pence of aloul 000, 00, which ia about Seventeen njiks in length, into which water bas never been introduced, part of which has been laid for aoout tour years, other parts ot whioh have been laid for about year, some ot which has cever been covered with and the whole of wbicb may, in its preaeoi conaiitn, be rapidly decaying can be saved, tbe other property of the company, with its franchise, will oe veiy much diminished in value. To relay this line of supply pipe will involve a large expense, pioUibly amounting to $300,000 or $4)3, 000. would, thttvlore, be probable that the property would be purchased only by those able and willing to aavanoe at least lhat sum of money to re-lay this line of pipe, should it be necessary, before any return from their purchase could be boped for. If.

however, this line of wooden supply pipea can be successfully tested, and water can be introduced through tbe same so as lo show that it need not be re-laid, ir. is obvious that a much better price can be obtained at tbe foreclosure sale, aud a much larger dividend paid upon the bonds secured bv tbe mortL-arre in suit. With a view to obtain tbe funds to make this espe nn tent, the application for the receiver waa made to include a provision, giving those who should ad vanoe monev in oruer to introduce water into the pipea and protet-t the property, a lien lor tbe moneys thus advaaoed, prior to all other claims oa tbe fund to be produced bv the foreciosnre sale, except the ex penses of the action. The language of this por tion oi tne oruer was careiuuy irauaea by tbe court; and the condition that tbe money, when advaceed, should be expended by the receiver. under the order ana auection ot tne court, tor this particular purpose, before any such priority should be obtained, would seem to protect the rights of any bondholder who might not be able or willing to contribute for that purpose.

It is necessary that conoert of action should be arrived at between the holders of all the bonus ss to the making of such advance, as well aa to tbe course to be pursued when the property is brought to sale. We earnestly hope such sale may be obtained during tbe present season. 'Ibe experiment ot introducing water into the pipe niuat also be made beior the ooai- meweemeni of the next winter. tbereiore riven tbat a meeting of all Demons holding tbe bonds above mentioned will be held at our office, in the building of the r.quitable Lite Assurance Society, No. 120 Brvadway, New Turk city corner of Cedar stre-t), room No.

47, on tbe lath day of September int. at 12 aa. tor tbe purpose of mu tual eonsul'ation, and to obtain eoncert of actkm in reference to the advance of money to tbe receiver, and the course to be pursued at the foreclosure sale. BlBDABTS Sl CbOABT. 120 Broadway, room 47.
