The injunctioa in the suit brought against the owners of the Stranger was not removed oa tbts ground tiist Buell avenue was a public street, as was stated ia the petition presented to the Council, but on entirely diSerent grounds. it appears that down to 1S64 Buell avenue was a public Highway. Ia that year the Com-n on Conntil totk steps to have tbe street closed, scd a resolution was adopted declaring tbe highway discontinued. 1 cere is some quesiioa as to whether these proceedings were regular.

If they were not, tbe ity did sot lose its control over tbe street. If thty were regular, there is alio a further question wb. ther Buell avenue has not been used by and opened to the public In such a dancer since lbo4 as to still render it a public highway. Cn tbe whole, I am of the opinion that It is by no means certain that the city has any interest in thia street. It is, however, ss I understand, a mittcr of consicerable Importance tbat if the public have any rights in this avenue leading to the river, they should be preserved.

1 would therefore recommend, provided the Common Council think it of Sufficient interest to the community to incur tbe chance of the expense of litigation in case the city should be defeated, that the City Attorney be instructed to take legal proceedings to have the question of whether Buell avenue ia a public highway decided by the courts. 1 he owners of the property, by their counsel have expressed an entire willingness to expedite the decision of toe matter as fast as pcsiale. 223, 1374. To the Common Council of the City af Soehetier Gektlxwks: In answer to your inquiry as to what cou'd be done to prevent accidents at the Goodman street crossing of the Central, I would say tbat the statute requires the bell to be rung or whistle sounded before crossing any street, and that railroads are bound to exercise great care in crossing; streets in populous cities. But the city of Rochester has nofhins; to do with enforcing these provisions. It the railroad negligent it is liable to the persons injured. -The Commas Council has tbe right to regulate the rate of speed of trains in the city.

There seems to be no limit to the speed trains can run at the Goodman street crossing. West of North street they can oniy be run at eight miles per hcttr, but the Council has made no regulation as to streets esat of that, that I am aware of. The result of the work thus far has more than justified the most sanguine snticipatioas of its advocates. The fire protection is perfect over at least three-fourths of the value of the property of tbe ly, and may fairly be pronounced unsurpassed by any city in the con a try. Although it was not expected that during the period of conjunction there should be muza demand for water, yet up to the let of July ov-r twelve hundred attachments have been made and the water is being freely used in every direction. There need be no apprehension in regard to the probable consumption when the pure water from Hemlock Lake shall be brought down to us. There is evidently an almost unanimous desire to use it st once upon its arrival.

The Increasing scarcity of water derived from wells snd cisterns has made a supply from eone other source very generally imperative. Besides many are eager to avail themselves of the many luxuries of baths and closets and founiains which sn sbundsnt supply of water may provide. The manufacturing esiabliah-nrtcts are very generally msking their connections with tbe pipes as fast as they are laid aiocg their tronts, and will be large consumer. Tte work in all Its details has been very thoroughly done kbd may safely challenge comparison with any works of a similar character in this or as; other country. Tbe reservoirs are pariculariy remarksble for the Strength of their embankments and the superior construction of the face walls, and should be seen to be folly appreciated.

We trust to be able on the 1st of January next to make report of a very large prop-wiion of ibs whole work completed and of sufficient progress so that the time of the introduction of the Hemlock Lake water may with some certainty be predicted. Tbe season has thus far been very favorable for operations, and if it rbeuld continue so late into tbe months of autumn a very large amount of work will be accomplished. measure of energysaalt be lacking on our part to bring the work to a speedy completion and in a manner that we believe our citizen' 6bali feel a just pride in having a perfect system of wster works. The ttopUof the Istate of New York, represented bt tmate and Amtembly, do enact am foliowm; Sbction 1. Section two hundred snl twelve of an act to amend an act entitled An act to amend and consolidate the eevera! acts relating to the barter of the city of Rochester," passed the eighth of April, eighteen hundred and sixty oie, and the several acts amendatory tbeieof, is hereby amended so as to read as tolloas: 212. Except as the commissioners of public works may otherwise determine or direct, it stall in all cases be the duty ot the owner or owners of every lot or piece of land in said city to Keep the tide walks adjoining his or her or their lot or piece of land, and also tbe street or alley adjoining the same in good repair, and also, (if the premises are not actually occupied) to remove and clear away all snow and i or other obstructions from said side-walx.

The commissioners ot public works may, by resolution, ss often as they may deem proper and necessary, give public notice by advertisement in the official newspapers published and tiuitt in said city, for fifteen days, requiring ail oa bets ol such lot. i 2.
