(AP) A federal appeals court in two opinions yesterday reaffirmed the Coast Guard's right to board and search vessels reg- istered in the United States or under U.S. jurisdiction. In one case, three men convicted in a North Carolina federal court of possession of marijuana with intent to distribute claimed the federal law allowing searches of U.S. ships outside territorial waters was unconstitutional Jesus Orlando Alonzo, Israel Zafra 4nd Alberto Lluis were arrested when their boat was boarded some 250 spiles off the North Carolina coast and $ome 12,000 pounds of marijuana discovered aboard.

They claimed that provision extended the jurisdiction of the U.S. "to the nigh seas" in violation of international (reaties and the Constitution. But the 4th U.S. Circuit Court of Appeals said yesterday that while the cannot assert its authority on the high seas in general, "it does have the authority to punish violations of criminal laws on board flag vessels of the United States." There was sufficient evidence to find that the marijuana-laden ship, seized some 250 miles off the North Carolina coast, was a U.S.-registered vessel, the court said. The ship was flying a U.S.

flag and Jiad "Miami, Florida," on its stern. When asked to provide documentation papers, the crew supplied a valid Florida boat registration in the name of a Miami man. I In the second case, Michael Allen appealed his convictions of drug Smuggling on grounds that marijuana used as evidence in the trial was obtained during an illegal search of a vessel seized in the York River in tDecember 1980. Allen was convicted federal court in Norfolk, Va. The marijuana was discovered on the Silvano when Coast Guard crewmen boarded the vessel Silvano in December 1980 to check on its registra-, tion.

When they opened a hatch to the main hold to check a documentation number, they found it full of burlap bales with the characteristic smell of marijuana. The appeals court ruled that the trial court was correct when it allowed the marijuana to be introduced in evidence because the Coast Guard's right to search "does not require probable cause nor reasonable suspicion." 18FM SHARP Linytron Plus In-LineOne Gun Picture Tube Automatic Fine Tuning 9 One Button Picture Balance Control 9 Rapid On Picture and Sound. "He's not always there in my thoughts, not the way it was in the beginning when I would wake up and think of him immediately," said Aykroyd, who has been noticeably silent about his friend, who died March 5 of a drug overdose. "I know when I go back to my house on Martha's Vineyard I will pass his grave, and I will have to go there and eat a chicken and drink a six-pack," he said. Aykroyd said that he supported the Los Angeles County grand jury investigation into Belushi's death. "I think it might discover that he didn't die of heroin but of natural causes," he said. "John lived twice as much as most people," Aykroyd added.

"He had lived the equivalent of 66 years when he died, not 33. He was always nonstop, full-out from the first time I met him." On his own in a Hollywood movie for the first time, Aykroyd seems ever conscious of his "late partner," Belushi. Aykroyd sat down for a recent inter-; view in a cushioned leather chair that had been Belushi's. The Universal Stu-I dio office is bare of decoration, except for a color poster advertising the late John Wayne in the movie, Jet Pilot. 1 There's also a moose head with a I crashed model of a World War I Ger-; man triplane in its antlers.

"I inherited this office from John, including the moose head," the rangy Canadian said. "I bump my head on it I several times a day. I think it may be some kind of a message." Aykroyd currently is starring in Un-! i versa I's Dr. Detroit as a college pro-; fessor who accidentally becomes en-' meshed in the Chicago underworld, Except for a 1975 Canadian feature, Love at First Sight, all of Aykroyd's previous films had been with his Sat-1 urday Night Live partner, Belushi: 1941, The Blues Brothers and Neigh- bors. "Dr.

Detroit was planned before John's death," Aykroyd said. "Our plan was that each of us would make a i picture alone. If John appeared in my, film, it would have been very brief, and vice versa." Aykroyd was born in Ottawa to a government official and his wife. He studied criminology at Carlton Uni-! versity, and then began performing with the Second City comedy group in Toronto. 1 Saturday Night Live producer Lorne Michaels invited Aykroyd to New York for an audition, and he became the valuable "utility man" of the Not Ready for Prime Time Players.
