But city officials stand by their code enforcement activities at By LARRY HOBBS Palm Beach Post Staff Writer WEST PALM BEACH Jerry Ostry's antagonists wielded their power like a set of brass knuckles and appeared willing to stop at nothing to see his downfall, a Palm Beach County jury was told. But it wasn't a mobster or a ruthless rival who attacked and threatened Ostry and his Eartners, cut off power to his uilding and interfered with efforts to upgrade his apartment complex, lawyer Isidro "Sid" Garcia said. It was the city of West Palm Beach, "motivated by spite" and vengeance, Garcia said.

The jury agreed with most of Garcia's arguments and awarded Ostry $230,700 in damages during a seven-day civil trial that ended last week. The jury determined that code enforcement and building inspectors from the city committed "unlawful interference with business" at The Castle apartments that Ostry owns at 4211 Parker Ave. It found also that the city Ostry more than $100,000, the lawsuit said. Meanwhile, Garcia said, building officials thwarted efforts to complete the upgrades in a series of "raids" on the building in which they harassed Ostry and his contractors. On one occasion, Garcia said, building inspector James Cossett forcefully grabbed Ostry in a threatening manner that caused Ostry pain.

Ostry said he did not re- Eort the incident to police ecause there were no witnesses. Cossett has since retired. West Palm Beach Construction Services Director Neil Melick, who is named in the suit, said Monday the city has acted properly in dealing with Ostry. Much of the work was started without permits, he said. He said Cossett did not assault Ostry.

"We disagree with the jury's finding." larryhobbspbpost.com By LiBBY WELLS Palm Beach Post Staff Writer The rarest of the world's sea turtles, a species that lays its eggs almost exclusively in Rancho Nuevo, Mexico, on the Gulf Coast, has nested at the north end of Jupiter Island in Martin County, according to an environmental consulting company whose biologists witnessed the animal. A Kemp's ridley sea turtle came ashore numerous times in May and June about three-quarters of a mile north of St. Lucie Inlet Preserve State Park's south boundary near the Hobe Sound National Wildlife Refuge. Carrie Crady, a biologist with Ecological Associates was the first to see the turtle, which was missing part of a rear flipper that made it difficult to excavate a nest in the sand.

"She tried to dig her egg cavity and kept coming out of the water and going back," Crady said. "A week later I saw her again. I went up behind her very quietly and tried to help her, but she went back to the water. I was kind of bummed she didn't lay any eggs." After weeks of trying, the turtle finally succeeded in digging an egg hole. "She did nest," Crady said, "but why she decided to nest down here is a mystery for all of us." It is only the 10th Kemp's ridley sea turtle, nest documented in the state since 1993 and the first on the Treasure Coast.

The Kemp's ridley named after fisherman Richard Kemp who discovered one in Key West around 1880 is the most endangered of the seven sea turtle species. Biologists put a cage around the nest on Jupiter Island to protect it from predators. The eggs are expected to hatch around the end of July. Afterward, Garcia said, the city ordered power turned off at the eight-unit complex from September 1999 until May 2000, Garcia said, costing Ostry $40,000 in lost income.

From there, he said, the dispute escalated to physical confrontations against Ostry by city employees and threats against Ostry and his contractors. Garcia said "unnecessary" improvements ordered by the city included raising a ceiling 4 inches, installing sheet rock between floors and electrical rewiring and re-plumbing. In a carriage house Ostry owned on Alamanda Avenue, the city ordered Ostry to remove $700 worth of Alamanda shrubs and replace them with cactus, Garcia said. The improvements cost Ostry's apartment complex and say it was strictly business. West Palm Beach City Attorney Claudia McKenna said the city plans to file a series of motions to have the verdict set aside andor reduced.
