Teacher could have done more, lawyer says VERDICT From 1B Richard Kilgore. This isn't the first time a school district has been held at least partly responsible for an altercation on a school campus.

In 1994 a Palm Beach County jury awarded a former Santaluces High School student $50,000 after he was beaten by other youths in 1991. The school district was found 66 percent negligent in that case, and the students who inflicted the beating were found 34 percent negligent. In the Fort Pierce Central incident, Axley, then 16, was injured after he loaned his Walkman radio to another student who refused to give it back. The teacher intervened, forcing the student to return Axley's radio, according to court documents. As the two students left the portable classroom, the angry student punched Axley from behind.

As a result, Axley underwent surgery to repair broken bones around his right eye. Also, his doctors testified he still has headaches and swelling of his lower eyelid. Axley's attorneys argued that the teacher, William Bell, could have taken additional steps to prevent the attack. He could have removed the other student. from the classroom or signaled; the front office for help by using a panic button in the classroom, said attorney Paul McMahon: Also, he should have anticipated trouble because another student in the classroom egged the boy on during class, McMahon said.

The school district's defense attorneys said Bell acted properly and that he did not hear the other student's comments. The four-day trial, presided by Senior Judge Rupert Smith, was Axley's second. Judge Robert Hawley halted Axley's first 'trial March 29 after two jurors told him they were contacted by a Palm Beach Post reporter. The reporter said she was trying to call jurors from a different case and was given the wrong jury list by a court clerk. GRANT REVELS PERRY Of Royal Palm Beach, FL.
