Murphy and Wilmore are being tried together for the third-degree felony. In opening statements Friday, Murphy and Wilmore's attorney, Mark Orr, said their arrests were politically motivated because the pair objected to a city project worth millions. "I don't have to tell you what happens when people get in the face of government," Orr said. "The state has not proved that Mr. Wilmore intended to do anything wrong." Orr said because the actions of Murphy and Wilmore would not have affected the utility project's outcome, they don't constitute perjury in an official proceeding. For that crime to occur, the state must prove that the action had a "natural tendency to influence, or be capable of influencing, the decision of the decision-making body to which it was addressed." Murphy said all prosecution witnesses have "a self-serving interest" in convicting him . . they had predated a land-sale contract and then lied about it in sworn depositions to give Murphy a legal right to challenge Phase 2 of the citywide utility project Wilmore told an investigator he lied because he was prompted by another utility opponent and "was looking for what is known as justice." Hundreds of residents objected to the project because of its cost to homeowners who previously paid little or nothing to use private wells and septic tanks. Murphy told investigators he drafted the option contract after Aug. 30, 1996, but back-dated it to Jan. 4, 1995, to reflect the day he and Wilmore first discussed the sale of land in Phase 2. If Murphy had placed the true date of the contract on it, he would not have had standing to oppose the utility project because a judge had ordered that all property interests had to exist before Aug. 30, 1996. The contract bore a notary seal that didn't exist until May 15, 1995, leading Port St Lucie's city The two lied about the contract date, prosecutors say. By Teresa Lane Palm Beach Post Staff Writer FORT PIERCE Government critics Sean Murphy and Bill Wilmore didn't like Port St Lucie's costly utility expansion-and perjured themselves in an effort to stop it, a prosecutor told jurors in opening trial statements Friday. ' , But Murphy and an attorney for Wilmore, a former school bus driver, say their actions weren't criminal because, in the end, they wouldn't have affected the city's - utility project anyway. It will be up to a six-person jury Monday to decide whether the pair are guilty of a crime that could land them in prison for up to five years, but more likely would result in a one-year county jail sentence or less.
