By Christine Stapleton Palm Beach Post Staff Writer : WEST PALM BEACH -The plea bargain Tyler Speck got on Oct 30 wasn't such a deal after all, Speck decided. Speck, who caused a deadly crash in 1987, pleaded guilty in October to driving without a license. In exchange for his guilty plea, Speck thought he would serve a year on house arrest. Speck was fitted with a House-arrest ankle monitor and sent home to Jupiter. But three weeks later, Speck was taken back to jail and told he wasn't a Candidate for house arrest and would have to serve his one-year sentence at the Palm Beach County Jail. On Friday, Speck and his lawyer, Bill Abramson, came to court and asked Circuit Judge Kenneth A. Marra to put Speck back on house arrest. If Judge Sheree D. Cunningham agrees that Speck did not get the deal he agreed to, Assistant State Attorney Maureen Acker-man said prosecutors would be more than happy to try the case. If convicted, prosecutors would insist that Speck go to jail, Ackerman said. Speck, 39, permanently lost his license in 1988 after he pleaded guilty to manslaughter by culpable negligence for causing a crash and leaving the scene of a crash that killed Lisa Bjork, the daughter of former school board member Gail Bjork. Speck served 13 months of a 6-year sentence. Sgt. Charles Meeler, head of the sheriffs house arrest program, testified that inmates convicted of homicides aren't eligible for house arrest Abramson argued that Speck was convicted of manslaughter, not homicide, and should qualify for the program. "Death is death," Meeler said. "It doesn't matter to me if it's manslaughter or homicide, death is death and that would automatically disqualify him." Abramson said someone at the sheriffs office initially approved Speck for the program and it was only after news reports of Speck's release that his house arrest was revoked. Marra continued the hearing after Abramson insisted upon testifying for his client. Abramson vowed to appeal Marra's decision not to let him testify. In the meantime, Speck stays in jail.
