Circuit Judge Scott Kenney called the county development code "nebulous and unclear" when it deals with the legal density for hotels on Hutchinson Island. Mclntyre agreed the rules could have been written more clearly. Attorney Charles Ray, representing the developers, said he didn't present every bit of evidence at the commission meeting because "we would be there all hours." 'They do that in Martin County," Kenney said. 'That may be their problem," Ray said. "That may be why Martin County has so many problems." The judges will announce their decision in the case later. Circuit Judge Burton Conner said commissioners could have read records on the project and not relied entirely on what was presented at the meeting. "We don't know that they didn't and you don't know that they did," Cornett said. "It's pure supposition." Commissioners approved Wrynne Building Corp.'s plans for a six-story, 102-room hotel last July. Plans call for the hotel building on the ocean front east of SR A1A while additional parking will be provided across the street slightly to the south. "The two parcels don't match. There's a chunk missing," Cornett said. "They're not contiguous." But county officials said boundary lines of the two parcels would intersect on SR A1A if extended and that makes the par By Jim Reeder Palm Beach Post Staff Writer FORT PIERCE Three circuit judges got to ask the questions Friday, grilling attorneys about St. Lucie County commissioners' approval of a 102-room hotel to be built on South Hutchinson Island. Attorney Jane Cornett, representing the Sea Winds Condominium Association and Presidents Council of Hutchinson Island in a court challenge, said commissioners weren't justified in approving the hotel. Insufficient evidence was presented at the commission meeting to show the hotel plan meets county requirements, Cornett said. "How can there be due process if the evidence is not pre sented?" Cornett said. "It's a public hearing, for the public, not just the commission and staff."
