Herndon, 36, was as an agriculture teacher at Marshall Middle School in Plant City. When applicants seek teaching jobs, school officials send their names and fingerprints to the Florida Department of Law Enforcement and the FBI. In 1994 Herndon was an associate professor of agriculture at St. Catharine College, 35 miles west of Lexington, Ky. Two weeks ago, Bentley concluded that Provenzano's sometimes bizarre behavior does not mean he's insane. That order was the issue being considered Tuesday by the high court, which two weeks ago pushed Provenzano's execution back 10 days to Sept 24 to allow time for an appeal of Bentley's Funeral Home Family Owned & Operated Appreciate the Difference 250 Center Street, Jupiter 744-2030 Provenzano Pariente said. "Here we are now how many weeks later without having the testimony of Dr. Fleming." Ditimar, an assistant attorney general, said the state was frustrated too: "They can take one witness who's out-of-state and say 'She's not available, she's not available' and continually put the execution off indefinitely." But Michael Reiter, Provenzano's lawyer, said his office did its best to get Fleming there and questioned why Bentley couldn't have allowed her to testify last week. Fleming wasn't present at Tuesday's oral arguments, but she wrote the Supreme Court a letter last week expressing her own "grave concern" about the way the case has been handled by everyone involved including the judge, the state and Provenzano's lawyers. She also repeated her belief that Provenzano is delusional. "At best, Mr. Provenzano knows he is being executed because he is the one and only Jesus Christ and 'they hate Jesus Christ.' " FUNERAL NOTICES ruling. The main issue debated Tuesday revolved around the psychologist who reported that Provenzano was incompetent earlier this summer but who did not appear at the hearing before Bentley two weeks ago. Patricia Fleming, a psychologist in Cheyenne, Wyo., said she couldn't testify until the week after Labor Day. Both Chief Justice Major Harding and Justice Barbara Pariente asked the attorney for the state, Carol Dittmar, why Bentley could not have waited a couple of more days to hear Fleming's testimony. "The frustration here is that Dr. Fleming's affidavit had some compelling information in it," jl1 EDWARD "SPUD" BERNDT III Age 54, of Jupiter, Florida, passed away September 11, 1999.
