Palm Beach Post, Friday, December 10, 1976 A9 Carter's Ohio Win Uncertain The apparently contradictory ruling was issued yesterday morning by U.S. District Judge Joseph P. Kinneary in Columbus. He turned down a request that he stop Secretary of State Ted W. Brown from issuing a final certificate saying that Carter had beaten President Ford in Ohio by 11,116 votes Nov. 2. Kinneary refused to stop 25 Democratic (c) Washington Star WASHINGTON - A federal judge in Ohio yesterday gave state officials permission to declare Jimmy Carter the winner of the state's 25 electoral votes. At the same time, the judge refused to dismiss a lawsuit filed by the U.S. Labor party and several state Republican politicians claiming that Carter's victory was based on widespread voter fraud. By keeping the case alive, he gave the challengers a chance to prove to him that there was illegal fraud and that this affected the outcome. He expressed doubt that the challengers could offer sufficient proof. The Electoral College is scheduled to meet Monday in Ohio and in all other state capitals (except the District of Columbia electors, who meet in Washington) for the electors to cast their vote for Carter and Ford. If the election results are followed, Carter would win 297 votes, 27 more than he would need - and Ford would get 241. Under the Constitution, the Electoral College has the final choice. If Judge Kinneary did conclude after Monday that the election results in Ohio were illegally obtained, an issue would then arise over whether he could do anything about it in a practical sense. Heller called President Ford's economic performance "lackluster." With Carter, Heller said, "We could have a considerably better outlook by the second half." The economist also said "almost nothing Mr. Carter can do in terms of revving up the economy" will increase the nation's inflation rate. ATLANTA (UPI) - Economist Walter W. Heller, former chairman of the President's Council of Economic Advisors, said yesterday he does not expect President-elect Carter's economic policies to have a major impact until late next year. Heller, among the economists advising Carter last week in Plains, said he expected a 6 to 7 per cent growth rate in the nation's economy by the second half of 1977.
