A6 Palm Beach Post, Thursday, December 9, 1976 Hays Sex Scandal Investigation Ends 20 off the JCPenmiey LACK and SPOTCOAT formed his power base and fade into the background. He refused, but Miss Ray kept the scandal lively by doing interviews, writing a spicy "novel" about Capitol Hill high jinks and posing nude for men's magazines. House Democrats, step by step, forced Hays out as chairman of the Administration and Democratic campaign spending committees. On June 10, Hays was hospitalized in a coma from an overdose of sleeping pills. He said later the overdose was accidental. In August, ignoring Hays' pleas that he was too ill to defend himself, the Ethics Committee voted unanimously to investigate Miss Ray's charges and determine whether he should be punished for immoral conduct. Hays, who already had announced he would retire at the end of this term, quit fighting with a one-sentence letter to the speaker of the House. "Dear Sir," it said, "I hereby resign my office ... effective immediately." Hays lives on a farm in western Ohio. Miss Ray is pursuing an acting career. The perfect look. Once you put it together, you want it to stay that way. It will. It's Dacron. 1 A The "Ups and Downs" Complete Stock Reporfi. Read the POST. Subicribe today. Call Circulation Now! 659-1450 WASHINGTON (UPI) - The Justice Department disclosed yesterday it has closed its investigation of the Elizabeth Ray sex scandal and will not prosecute former Rep. Wayne Hays, Miss Ray's onetime paramour. Under constraint of a judicial gag order, Justice Department spokesman Robert L. Stevenson refused to discuss the decision except to say the case is closed and "prosecution has been declined." The Washington Star quoted a source familiar with the investigation as saying there was not enough evidence to support the only potential charge against Hays - That he misused federal funds by maintaining Miss Ray as his mistress on the public payroll. "There just wasn't enough evidence," the Star's source said. "It basically was a case of a human being's sexual weaknesses ... a political problem rather than a prosecutorial problem." Stevenson said Hays has been notified the grand jury investigation is finished and no charge will be pressed against him thus closing the book on a scandal that knocked the Ohio Democrat off the pinnacle of congressional power, broke his health and forced him to resign in disgrace Sept. 1 after 28 years in the House. The House Ethics Committee dropped its probe of his conduct the same day, leaving only the prospect of federal prosecution. . Hays' downfall began May 23, when the Washington Post published an interview with Elizabeth Ray, a platinum blonde, 33-year-old former Capitol Hill secretary who said he got her a $14,000-a-year congressional staff job where she did nothing but serve as his mistress. "I can't type," she said. "I can't file. I can't even answer the phone." Hays, 65, who relished a reputation as "the meanest man in Congress" - an acid-tongued master of insult who called colleagues names like "potato head" - at first denied Miss Ray's story. A few days later, he admitted they had had a brief affair, but denied he had hired her for that purpose. He said he tried to cover up the affair to protect "the woman I love" his bride of six weeks. Democrats fearing backlash from the sex scandal in an election year tried to persuade Hays to give up the committee chairmanships that Communist Mayor, Pope Meet in Rome ROME (AP) - Pope Paul VI and Rome's new Communist mayor shook hands yesterday beneath a statue of the Virgin Mary in a symbolic rite of detente. A crowd estimated at between 7,-000 and 10,000 persons strained at police barriers in the Piazza di Spagna for a glimpse of the meeting viewed as significant for relations between the Vatican and the Marxist administration in this city of popes. Giulio Carlo Argan, an art history professor picked as mayor by the Communist party in August, and the 79-year-old leader of the Roman Catholic church spoke for about two minutes after the pontiff laid a wreath of red and pink roses beneath the big statue of Mary to mark the Feast of the Immaculate Conception. Argan, wearing a sash with the Italian tricolor, bowed slightly, then the two shook hands. "The pope was extremely affable," Argan said.
