Hays, who already had announced he would retire at the end of this term, quit fighting with a one-sentence letter to the speaker of the House. Call Circulation Now! 659-1450 WASHINGTON (UPI) - The Justice Department disclosed yesterday it has closed its investigation of the Elizabeth Ray sex scandal and will not prosecute former Rep. Wayne Hays, Miss Ray's onetime paramour. Under constraint of a judicial gag order, Justice Department spokesman Robert L. Stevenson refused to discuss the decision except to say the case is closed and "prosecution has been declined." The Washington Star quoted a source familiar with the investigation as saying there was not enough evidence to support the only potential charge against Hays - That he misused federal funds by maintaining Miss Ray as his mistress on the public payroll. "There just wasn't enough evidence," the Star's source said. "It basically was a case of a human being's sexual weaknesses ... a political problem rather than a prosecutorial problem." Stevenson said Hays has been notified the grand jury investigation is finished and no charge will be pressed against him thus closing the book on a scandal that knocked the Ohio Democrat off the pinnacle of congressional power, broke his health and forced him to resign in disgrace Sept. 1 after 28 years in the House. The House Ethics Committee dropped its probe of his conduct the same day, leaving only the prospect of federal prosecution. . Hays' downfall began May 23, when the Washington Post published an interview with Elizabeth Ray, a platinum blonde, 33-year-old former Capitol Hill secretary who said he got her a $14,000-a-year congressional staff job where she did nothing but serve as his mistress. "I can't type," she said. "I can't file. I can't even answer the phone." Hays, 65, who relished a reputation as "the meanest man in Congress" - an acid-tongued master of insult who called colleagues names like "potato head" - at first denied Miss Ray's story. A few days later, he admitted they had had a brief affair, but denied he had hired her for that purpose. He said he tried to cover up the affair to protect "the woman I love" his bride of six weeks.
