The money was recovered. Lynch asserted he was Bronfman's lover and was forced into an abduction scheme by Bronfman's threat to disclose he was a homosexual. The jury also heard testimony by Bronfman that he accidently sat on a gun while blindfolded and handcuffed with his arms behind him. Bronfman said he decided it was "ridiculous" to make an escape try and turned the gun over to his captor, who then pressed a second weapon into his hand to show he would have beer, covered anyway. "So you touched both of the weapons?" asked Walter Higgins, Lynch's lawyer. "Yes sir," Bronfman answered. Higgins contended Monday in his summation of the eight-week trial that Bronfman made up this story because he had supplied both weapons for a hoax kidnaping and wanted to be able to account for his fingerprints if they showed up on either of the guns. WHITE PLAINS, N.Y. (AP) - The jury in the Samuel Bronfman II kidnap trial appeared yesterday to be closely examining a defense assertion that his sensational $2.3-million abduction last year was a hoax. Deliberating for their second day, the jurors asked to hear again testimony on the defense contention that Bronfman was left unguarded at times and could have escaped. A court reported read back the testimony of Morris Greenberger, 73, who said defendant Dominic Byrne visited him in the hospital at a time when the prosecution says he was guarding Bronfman. Greenberger said Byrne visited him about noon on Aug. 15, 1975. Testimony and New York City fire department records place Byrne's co-defendant, fireman Mel Patrick Lynch, at work at the same time. Bronfman, 23, heir to the Seagram whisky fortune, had said Byrne and Lynch alternated guarding him for the nine days he was a captive at Lynch's Brooklyn apartment after the Aug. 8, 1975, abduction.
