Lewis said the Cabinet, approving a $157,525 budget for authority in the current fiscal year, told the canal authority to spend $45,000 in legal fees. The authority is close to exceeding the $157,525 mark. Because the authority oversees taxing districts along areas designated for the canal, it can dip into reserves and overspend Cabinet recommendations. Evans said the authority is not bound by the Cabinet figures or yearly attorney fee estimates. Lewis said since January, the authority has paid $52,264 to Ralph Elliott and $12,250 to Frank Decker. Both Elliott and Decker are Jacksonville attorneys. "Spending $64,514 for attorney fees is a waste," Lewis said. "My staff tells me the attorneys sit at meet- ings which don't relate to legal business and never say a word. We're paying them for that?" Evans emphatically disagreed. "The money is well spent," he said. "The comptroller is trying to second us . . . All of this relates to litigation. He can't sit back in an ivory tower and be oblivious to meetings and hearings which could relate to the final outcome of the TALLAHASSEE (UPI) - Comptroller Gerald Lewis, saying the state Canal Authority is overspending a budget approved by the Cabinet, questions why the agency this year has spent $64,514 in legal fees and $27,550 for private environmental consultants. Lewis feels the expenses are a waste of tax funds. He said the money is being used to promote completion of the Cross Florida Barge Canal, a violation of a Cabinet directive. But Col. Giles L. Evans Jr., manager of the authority, calls Lewis' comments and accusations "a cheap political potshot." The- fees, he said, are necessary because of increasing litigation and public hearings about the canal, which will be discussed before the Cabinet next week. The Cabinet is expected to vote on whether to recommend completion of the canal, halted in 1971 for environmental reasons. Mos; CaMnet members have indicated opposition to the project. "I1 wish the comptroller would call me personally about these questions instead of running to his staff and the press." Evans said. "Gov. (Reu-bint Askew has been more than fair to us in his opposition to the canal.
