"It is no longer a question these days of Peers vs. the People, but rather of Peers and People temporarily united against a government never popular and now widely despised or even hated," said the conservative Daily Telegraph. The Lords delayed enactment into law of a bill to nationalize the aircraft, shipbuilding, marine engineering and ship repairing industries. They also drastically amended a bill that would have given dockwor-kers a monopoly on cargo handling within five miles of any large port. The Lords limited the monopoly to a half-mile, thus excluding most of the country's container depots, cold-stores and warehouses. In the nationalization bill, the Lords excluded 12 ship-repairing companies and three shipyards from "the dead hand" of state control on the grounds they were financially viable and important earners of foreign currency. The government refused to accept the exclusions and allowed the bill to die. Meanwhile, a Labor party policymaking committee is reportedly preparing a fundamental reform of the Lords that would abolish the legislative rights of hereditary peers and radically revise the system of life peerages. Life peerages meaning the holder's title and seat in the Lords ends with his death were introduced by Prime Minister MacMillan in 1958 to infuse some new blood into the upper house. But they have become a form of political patronage to honor retired or defeated politicians a demonstration, as one commentator put it, that "there is life after political death." Labor proposals for a reformed House of Lords include seats for representatives of trade unions and industry in both the nationalized and private sectors. The propoals do not make clear how the representatives would be selected. Even supporters of the Lords' efforts to thwart Labor legislation have contended that the "undemocratic" aspect of the upper house the fact it is not elected is due for reform. Lord Blake, provost of Queen's College, Oxford, and a leading authority on constitutional law, wrote recently that "some of the ablest members happen to be hereditary peers, but one cannot justify their presence on grounds of heredity." of the House," says Michael Foot, leader of the House of Commons and another leftist Laborite. In one of the angriest confrontations between the two houses this century, some 60 Labor members of the Commons jointly accused the Lords of using their constitutional power to amend ' legislation in "a willful and politically motivated attempt" to wreck Labor party bills. "Unless we get rid of the Hell's Angels who come not on motorcycles but in Rolls-Royces every day to hold up the will of the people, we are never going to be able to transform the country on the mandate given us by the people," said one member, Doug Hoyle. "The critics in the House of Commons can jump into the Atlantic for all I care," retorted Lord Shinwell, who held ministerial posts in several Labor governments before being made a life peer in 1970. "We have to make a stand." The confrontation and the threat of a constitutional crisis has prompted such front-page headlines as "Mutineers in Ermine" in the Daily Express and a national debate on whether the Lords should be reformed to make them more representative, perhaps by some form of popular election. The 1,100 or so members of the House of Lords acquired their titles and ermine robes through birth, political patronage in the case of life peers, or by virtue of their office, for example the archbishop of Canterbury. Its critics view it as the political embodiment of Britain's class system. But few political observers believe the Laborites will succeed in outright abolition of the Lords, and any tampering with a part of the nation's heritage is likely to proceed slowly. The House of Lords has existed for more than seven centuries, reeks with tradition and, besides having a constitutional prerogative to amend legislation submitted by the lower house, it serves as the highest court in the realm. But the Lords have had their troubles, and their critics, through the years. Oliver Cromwell abolished the upper house of Parliament in 1649 because it "was found by long experience to be useless and dangerous to the people of England." But it was reinstated with the restoration of the monarchy under Charles II in 1660. The Duke of Wellington said, "Nobody gives a damn for it." Harold MacMillan called it "a mausoleum," and Harold Wilson tried, but failed, to reform it in the late 1960s. MacMillan, a Conservative, and Wilson, a Laborite, are former prime ministers. And some critics say their unelected lordships, like powdered wigs and hansom cabs, will inevitably pass from the British scene. A concerted effort to abolish or drastically alter the Lords has been mounted by Labor party members of the House of Commons, Parliament's lower house, because the Lords have delayed or amended key legislation prepared by the Labor government of Prime Minister James Callaghan. "The days of the Lords are quite genuinely numbered," says Anthony Wedgwood Benn, energy minister arid a prominent leftist leader of the campaign. Benn says he thinks that within 5 or 10 years Britons will vote in a government with a campaign pledge that "the Lords must go." Benn himself is an aristocrat who in 1973 renounced the title Lord Stansgate so he could sit in the popularly elected House of Commons.
