"Buddy" Herz. "Hopefully, this will once and for all put to bed, at least for now, any problems with the Park Board." The Moody Gardens board approved the proposal last Wednesday, Herz said, while the staff members did not reach a final draft of the plan until late Tuesday. Park Board trustees contacted Tuesday had not seen the plan but said the Moody board's action was encouraging. Chairman John Knust also said that Herz's announcement took him by surprise.

"I thought we had agreed that the staff members would negotiate the proposal to a final form before it was presented to either board," he said. Copies of the proposal were delivered Tuesday afternoon to trustees and the Hotel-Motel Association, said acting Park Board Director Lou Muller. The plan will be officially presented to the board at special meeting slated for 9 a.m. Monday, Muller said. It still must pass muster with the Hotel-Motel Association and be voted on by the Park.Board, Knust said.

"We have not reviewed it, studied it, or seen it yet," Knust said. About half of the state's 30 witnesses testified in Tuesday's second day of the capital murder trial of Kenneth Mosley, 38. Mosley has pleaded innocent to the Feb. 15 fatal shooting of David Moore, 32, a 10-year veteran of the suburban Garland Police Department. Mosley "kept pulling that, trigger into the officer" knowing full well that his victim was a policeman, a prosecutor told jurors. Moore was shown on videotape walking up behind Mosley and asking him to go outside with him for some questions.

The officer went to the bank after an employee got suspicious of Mosley. thinking he might be the same man who had robbed the bank previously. One segment of tape showed Moore lying on the ground just outside the bank after the officer and Mosley smashed through a window while skirmishing. As they wrestled, officials said, Mosley pulled a gun and shot Moore in the chest at pointblank range, a witness said. The defense complained that the stories of some of Tuesday's witnesses differed from the stories they initially gave police.

The prosecutor indicated it would put on its star witness today someone who saw everything that occurred during the skirmish. After Mosley and Moore crashed together through a window, Mosley stood up in front of the wounded officer and "literally finishes him off," Assistant District Attorney Jason January told the jury in his opening statement. "He knew it was an officer, and be pulled that trigger five times," January said. attorneys chose not to deliver an opening statement. Police officers were cleared from the courtroom Monday after a large number of them showed up in court in support of Moore.

Defense attorney Jim Oatman argued that the officers' presence was prejudicial to his client. State District Judge Molly Francis agreed and limited to sis the number of uniformed officers that could watch the proceedings. Other officers left, removed their uniform shirts and returned to the courtroom wearing black T- shirts. Moore and two other patrol officers arrived at Bank One after an employee called police about a suspicious person. Investigators learned later that Mosley had been sought for five days in connection with the armed robbery of a fast-food restaurant in Mesquite, another Dallas suburb.

Mosley was separated from his wife at the time and had been fired from bis last known job, at Coca- Cola Bottling in May 1995 after testing positive for cocaine during a random drug test, court records show. "The financial goals would fit with any type of vision for a ciiy, but we want to use the goals toward a total picture of the city," Frankovich said.
