1 1 Albany Democrat-Herald Saturday, March 26, 1949 Board Absolves Swink, Ferguson (Continued from Page One) of this association, and when Mr. Swink was solicited to undertake the supervision of the construction of the schools both he and the board understood thet any contract 1 for such supervision would be between Mr. Swink and his associates, the Ferguson Wood Products on the one hand as supervisors, and the board as owners on the other. "The board tendered a proposition to the prospective supervisors and in oper neeting discussed the details of a proposed contract and the contrict was read into the minutes which were approved a unanimous vote of the board. All this is being shown by the minutes of the board for the meeting held on the 10th day of March, 1949, and the board was informed by its attorney that they had thus entered into and created a legal valid contract between themselves and Ferguson.

Swink and Mr. Ferguson, with the school board's approval, met with the engineer and started to lay out the foundation for Waverly school. "Neither Mr. Swink nor the Ferguson Wood Products Co. nor anyone representing them have at any time made any requests or claim for compensation for services furnished to the board for consultation and advice requested by and given to the board up to this date and until the supervisory arrangement by these people and the board was made public no builders or other interested citizens in the school district or elsewhere had ever approached the board to give them any assistance of any kind 1 with reference to the problem presented by the need for constructing buildings and staying within the budget." "release any and all they may have against your board for an account of any agreements or relations that they may have had with your board with reference to the construction of the three school buildings," adding that they "do not make any claims against the board for services rendered or for any other items of any kind." Pendleton Elks Club Manager Dies in Crash PENDLETON, March 26. (U.P) William L.

Dolan, Elks' manager of the Pendleton club, was killed and two others were injured last night in an automobile collision on Emigrant Hill, 20 miles east of Pendleton on highway 30. A car driven by Esther Lucille Marrs, Portland, sideswiped the Dolan car, forcing it off the road, state police reported. Mr. and Mrs. Harry Meyers, occupants of the Dolan car, were -injured seriously.

Mrs. Smith, who was born May 23. 1886 in Toledo, Ohio, moved to Gates in 1901 and to Mill City in 1938. She was married to William Grant Smith in 1896 in Ohio. Mrs.

Smith was member of the Rebekah lodge for almost 43 years and was a Past Noble Grand of the Santiam Rebekah lodge in Mill City, Funeral services will be held in the Weddle Funeral chapel in Stayton Sunday at 2 p.m., the Rev. Willard Buckner officiating. will be at the Fairview cemetery, Surviving are five sons; Robert J. Smith, Salem, Wilbur J. Smith, Sutherlin, Charles E.

Smith, Gates, Raymond G. Smith, North Bend and George French, Toledo, Ohio. Also surviving are two daughters, Mrs. Edith McCann, Burlington, and Mrs. Alice Hoeye, Mill City.

One son, Amos French, died in the first world war. One brother, Rudolf Navarre, Toledo, Ohio, survives.
