THE PALM BEACH POST WEDNESDAY, DECEMBER 30, 1992 SB Questions remain concerning fetal tissue in trash bin By CHRISTINE STAPLETON and SIOBHAN MORRISSEY Palm Beach Post Staff Writers WEST PALM BEACH Case 92-59669 will remain a whodunit in police files. But the attorney for a doctor suspected of illegally dumping fetal tissue will conduct his own investigation. Attorney Barry Silver said Tuesday that he intends to question people who work near Dr. Robert Livingston's Boca Raton office. Since Oct.

17 when a restaurateur found specimen jars of fetal tissue in a trash bin near Livingston's office Silver has said the doctor was framed by anti-abortion activists. "We're not going on any witch hunt," Silver said. "We'll probably ask a few questions." A nine-week investigation by Boca Raton detectives concluded there were other suspects and motives. But investigators said it would be impossible to prove who placed the jars in the trash. Livingston has been embroiled in a nasty lawsuit with abortion foes, who have admitted rummaging through his garbage before, Assistant State Attorney Spencer Levine wrote.

Livingston admitted he took out several bags of trash about 9 p.m on Oct. 16, the night Carlos Ricoarango, owner of the Cuban Cafe, said he saw the doctor at the Dumpster. The next morning, restaurant owner Ricoarango decided to search the trash bin. He found the containers and called the property manager. Livingston, shocked at the discovery, vehemently denied dumping any fetal matter.

Because he's been the target of anti-abortion protests, he's very careful about taking out the trash, he told police. Livingston cooperated with detectives. He said he had performed eight abortions Oct. 16 and showed the detectives the tissue, sealed in eight glass jars not like the plastic jars in the dumpster. Office workers and nurses said there were never any un-recorded abortions at Livingston's clinic.

Detectives then focused on Ricoar ango. They scoured his phone bills and asked him if he had ties to anti-abortion groups. Ricoarango agreed to take a polygraph test, which concluded he had nothing to do with placing the fetal tissue in the dumpster. Strict confidentiality laws prevented detectives from delving into Livingston's patient files to try to match blood types from the fetal tissues to Livingston's clients. No fingerprints were found on the 11 bloody containers.

During a luncheon meeting county commissioners told the delegation they were surprised the legislators were even considering placing Singer Island under county control. That would create an enclave that would force the county to cross as many as three city boundaries to deliver services, Commission Chairwoman Mary McCarty said. "You're thinking of doing something you would never let us do," she said. ate amount of the taxes, Singer Island residents have little say in how the money is spent, said Don Newman, a leader with the Singer Island Tax Relief Organization. City officials "listen to us politely and then go merrily about their wasteful ways," he said.

But Riviera Beach officials said Singer Island's bid to leave is premature. The city was never presented with any formal request by Singer Island residents to leave or a list of their problems, City Manager Tony Smith said. Allowing Singer Island to leave would also set a dangerous precedent, Smith said. SINGER ISLANDfrom IB from the County Commission and the state delegation. "I'd like to get this de-annexation talk behind us and just work on the economic issues," Merchant said after the meeting.

The committee is to report back to the full delegation by the end of March. Leaders of Singer Island's bid to withdraw from Riviera Beach said their community makes up just 12 percent of the city's population but 40 percent of its property tax base. "In conversations we were having with our supporters, which I would say are about 90 percent of the people, we have been told that the people making all the noise would be happy with this," said Burckart, who is also a Tequesta councilman. The commercial project has been the focus of opposition from residents who say it will ruin the area's rural character.

"There has been a misconception that we're going to build a huge mall. We're not," Burckart said. "We're building a town center for Jupiter Farms." But Jeff Burck, president of Jupiter Rural Residents, said the reduced center is still too big. "It still leaves it as a very large shopping center. They have reduced it from the sublime to the ridiculous.

We think it will be a regional draw," Burck said. The developers are conducting studies that they hope will show that the center will not increase traffic appreciably. They have agreed with county planners to build a sewer and water treatment plant on site. Planners were concerned that extending water and sewer lines from Jupiter would spur development, Burckart said. Burckart hopes the studies also will show that the shopping center would reduce vehicle trips on In-diantown Road between Jupiter Farms and Florida's Turnpike because residents could make fewer shopping trips into Jupiter.

In the first phase of the project, a gas station and two banks would be built. Offices would be built in the second phase, and retail shops and a grocery store would be built in phase three. Matos said he and his boss, housing director Faye Outlaw-Kirk, discussed his role and concluded there was no conflict in handling the project as a city employee. Matos said Outlaw-Kirk did most of the work on the council's application. Outlaw-Kirk said Gonzalez was wrong in his allegation that federal law requires the city to advertise that the money is available. She said advertising for proposals is at the discretion of the city.
