Gioiosa was convicted of transporting cocaine and of claiming Rose's race track winnings as part of a conspiracy to defraud the Internal Revenue Service. He is serving a five-year prison term. Rose's race track winnings aren't mentioned in the plea agreement. Rose has admitted he never claimed his gambling income on his taxes, but contends he lost more than he won at the track. One particular race track payoff, a $47,646 Pik Six from Turfway Park in northern Kentucky, became a central point in Gioiosa's trial.

Several of Rose's former gambling associates testified that Rose told Gioiosa to claim the winning ticket of Jan. 16, 1987, even though Rose owned a share ot it. Federal prosecutors pointed out that Gioiosa was in a lower tax bracket at the time. Gioiosa was the only one to sign a claim form for the Pik Six at the racetrack. The form, used for tax purposes, must include the name of everyone who owns a share of the ticket.

Gioiosa claimed the entire amount on his individual tax return that year. Rose didn't dispute that he owned a share of the ticket, and claimed in an interview last November that he was innocent of any wrongdoing. He said he didn't know he had to put his name on the claim form, too. Rose's agreement with the government will free him from any possible prosecution in connection with Gioiosa. The grand jury investigation was separate from baseball's investigation of Rose and had a different focus, though both involved information from some of Rose's former associates.

Baseball's investigators, led by John Dowd, focused only on whether Rose associated with gamblers, bet on baseball or bet on his own team. Dowd concluded that Rose used cash from memorabilia sales and autograph shows for gambling. Paul Janszen, another of Rose's former associates, cooperated with both investigations of Rose. Janszen, who traveled with Rose to card shows and claims to have run Rose's bets with bookmakers, said the former manager only reported a fraction of his income to the IRS. Janszen said Rose -always preferred cash payments for autograph appearances.

Los Angeles 6, San Francisco 2 The Associated Press CLEVELAND Tom Broo-kens tripled and scored on Rick Cerone's passed ball in the sixth inning, and Greg Swindell pitched 6Vi scoreless innings Thursday night as the Cleveland Indians won their twice-delayed home opener 1-0 over the New York Yankees. American League "I guess I had to prove something to you guys," Swindell "And I had something to prove to myself. It's been a long time since I won a ballgame. Some people said I was pacing myself. But what I've said was that I didn't think I would have all my pitches until May.

Swindell (1-1) bounced back from a horrendous first start in which he allowed four earned runs in two innings in a 9-4 loss at Chicago. He allowed three hits to the Yankees, striking out five and walking one. Cecilio Guante pitched 1 innings, and Doug Jones got the last three outs for his third save. Guante and Jones each allowed a hit. Martinez The Associated Press PHILADELPHIA Dennis Martinez's bid to pitch baseball's second no-hitter in two weeks ended when Darren Daulton doubled with one out in the eighth inning Thursday as the Montreal Expos beat the Philadelphia Phillies 5-0.

Daulton hit a 2-1 pitch over the head of center fielder Marquis Grissom for the Phillies' first hit off the 34-year-old right-hander. Martinez then retired rookie Dave Hollins on a grounder and struck out pinch-hitter Rob Booker. He struck out seven and walked one. It was Expos' first complete game of the season. Martinez pitched six perfect in nings before walking Len Dykstra leading off the seventh. Herr reached on an error by first baseman Andres Galarraga. Martinez struck out Von Hayes, who was ejected for arguing the call.

Martinez got Carmelo Martinez on a pop-up to short and John Kruk on an infield grounder to end the seventh. Bosio, who led the Brewers with 15 wins last season, struck out five and walked one. improved his career record to 19-3 against the Gooden threw 117 pitches and retired nine of the final 10 batters he faced and struck out five in his last three innings. Pirates 5, Cardinals 1 ST. LOUIS Bobby Bonilla's single broke an eighth-inning tie and Barry Bonds followed with a home run as Pittsburgh rallied to beat St. Louis. Cardinals pitchers had thrown 21 consecutive scoreless innings as Joe Magrane (0-2) entered the eighth with a five-hitter and a 1-0 lead. But John Cangelosi drew a leadoff walk, advanced on a sacrifice and scored the tying run on Gary Redus' triple.

Bonilla followed with a single up the middle and Bonds greeted reliever Frank DiPino with his first home run, clearing the 414-foot mark in straightaway center for a 4-1 lead. In the ninth, Andy Van Slyke hit his third home run of the season. Doug Drabek (2-1) gave up one run on three hits in eight innings. He struck out five and walked two. Ted Power finished with a hitless ninth.

Port Charlotte 4, St. Lucie 2 PORT CHARLOTTE The Rangers (7-7) scored twice in the sixth inning to defeat the Mets (7-7). Trey McCoy doubled in the first Rangers run and then singled to start the two-run sixth inning. He scored on a single by Bill Losa and the winning run scored on a double play. Four Charlotte pitchers limited the Mets to four hits.

Bryan Gore got the win and Dan Furmanik took the loss. Jim Hvizda earned the save. The Mets host Fort Lauderdale at 7 tonight to start an eight-game homestand. St. Lucie scored its runs on an Alan Zinter single in the fourth inning and a D.J.

Mets 4, Cubs 1 NEW YORK Dwight Gooden rebounded from two bad starts with a good one, allowing only one run in seven innings to win his first game since last June as New York beat Chicago. Gooden allowed 10 runs on 14 hits in 7 innings in his first two games.

Gooden (1-2), who struck out seven and walked two, has never lost three straight decisions.
