CL 70-41635 and CE-28-16358, and Adversary Action 89 A 7212, All Creditors and Parties in Interest YOU ARE HEREBY NOTIFIED that on June 12, 1987, John Carey Oil Company, Inc. tiled an action in the District Court in and for Polk County, Iowa against ENERCOR, Inc. and Iowa Resources Inc arisinq out of a certain Partnership Agreement entered Into as between John Carey and ENERCOR on or about March 1, 1984 The Iowa Suit seeks damages for alleged breaches of the Partnership Agreement in an amount in an undetermined amount. Subsequent to filing its Petition for Relief under Chapter 11 of the United States Bankruptcy Code on June 30, 1989, John Carey also separately filed on Adversary Proceeding in the United States Bankruptcy Court for the Central District of Illinois against ENERCOR and IOR arising out of the Partnership Agreement, wherein John Corey seeks recovery of monies in the amount of $274,147.56, which it alleges are owed it as a result of certain post-petition obligations arising under the Partnership Agreement Adversary In response to the filing of the Iowa suit, ENERCOR ond IOR have denied liability, have obiected to the right of John Carey to recover any of the amounts sought in its Complaint, and nave filed counterclaims against John Carey wherein ENERCOR and IOR seek damages for the alleged breach of the Partnership Agreement and breach of certain fiduciary duties on the part of John Carev. In response to the filing of the Adversary Action, ENERCOR and FOR hove restated their respective denials of liability, their objections to John Carey recovering any of the amounts sought in the Adversary Complaint, and their respective allegations concerning breaches of the Partnership Agreement and STATE Dexfielt! to forfeit last two games By PAT HARTY Milter Stall Writer Controversy surrounding the Dex-field of Redfield High School football team took a new twist Tuesday when Supt.

Robert Templeton announced the team would forfeit its remaining two games this season. He said the decision was made by a vote of the team Tuesday. The team has been in turmoil for the past two weeks after players charged that Coach Paul Topliff had physically abused a player and barred team members from homecoming activities after a 44-0 loss to Martensdale-St. Marys. Parents said players had threatened not to suit up again if Topliff was directing the team.

The coach voluntarily sat out Friday night's homecoming game against Van Meter so the game could be played. Van Meter won, 38-0. Tuesday night, Templeton issued the following statement: "A meeting of the Dexfield football team was held Tuesday after school. Football coach Paul Topliff was asked to be present, but did not attend. High school principal Kirby Norman conducted the meeting.

Supt. Robert Templeton was also present. "After discussion of the football situation, the majority of the students present voted not to play the remaining games this season. Due to injuries and ineligibilities, there are only 17 boys able to play. "Coach Topliff was to have resumed his coaching duties Monday.

The latest tug appears to be his last. The Board of Control of the Iowa High School Athletic Association voted Wednesday to reinstate Lynam's eligibility for the Wheelers' remaining games. The board's decision was based not on open enrollment but on a transfer rule that allows the board to use its discretion to approve competition for students who have reached the age of majority and who have transferred for a purpose other than that of interscholastic athletics. Lynam attended Exira last year but transferred to Audubon for his senior year, although his family continues to live in the Exira district.

A student in grades 10-12 who transfers under open enrollment rules is usually ineligible to participate in athletics for one year. "It was determined in the record originally that he didn't transfer for the purpose of athletics," said David Harty, assistant executive secretary for the athletic association. "On that basis and the fact that he was taken off open enrollment, they declared him eligible." Both the Exira and Audubon districts had to take Lynam off their open enrollment lists before he became eligible for the age-of-majority transfer exception. Lynam reached the age of 18 last week and will reside in Audubon while his parents continue to reside in the Exira district. "I'm a little numbed by all this," Lynam's father, James Lynam, said Wednesday.
