The court said the so-called contract Clayton Blue claimed he had with late Maid-Rite owner John A. Gillotti to sell the restaurant was void because it was suspicious. "We agree with the trial court the contract was voidable for duress," Judge Mark Cady said for the court. The dispute began in 1984 when John Gillotti, a retired West Des Moines businessman, made a $100,000 down payment so that Blue, a Russell farmer, could buy the company from William Angell, the founder. Gillotti died May 13, 1991, and Blue filed a claim against his estate contending that three days before his death, Gillotti agreed to sell the company to him.

In 1993, Blue's children said their father signed the right to Maid-Rite over to them. They then sued Gillot-ti's family and his estate. They asked the court to enforce what they said was a legal contract between their father and Gillotti to sell the company.
