Steve Young, the director of the Department of Inspections and Appeals, has said that his agency isn't changing the rules that govern assisted living. The only thing that has changed, he says, is that the state is now enforcing those rules.

Floral Tributes Satisfaction Guaranteed being done. It also would help, she said, if physicians and family members were consulted on certain issues. She said some aspects of the inspection process have improved since the department assumed its new duties in April. State inspections are now conducted in a more timely manner, she said, and there is more consistency in the way rules are enforced. But in a letter sent Friday to Vilsack, Sanvig complained that the inspection process was "very disruptive" and was "run like a nursing home kangaroo survey process where the cops are going to find out what's wrong, come hell or high water." The June inspection at Sanvig's Port Charles facility resulted in a report from the inspections department that is largely favorable.

In addition to a few minor deficiencies, inspectors alleged that a registered nurse had not evaluated each resident's condition every 90 days, as required. Sanvig disputes that, saying he could have provided documentation had the inspectors given him more time. He says residents of the facility are content with the care he provides and cites a recent state-sponsored survey of residents and workers at the home. Port Charles scored high marks in all aspects of resident and worker satisfaction. Two years ago, Sanvig was being paid by the state to inspect assisted living centers for Elder Affairs.

At the time, he was managing the Willow Pointe AssistedLiving Center in Mason City. In his role as a state inspector, Sanvig took a hard-line approach. He once recommended that the state assume complete control of Lakeview Lodge in Waterloo where, he said, residents' health and safety were at risk. Attorneys for Lakeview Lodge threatened to sue Elder Affairs, claiming the agency had "wasted tax dollars" and created a conflict of interest by having an industry official and potential competitor conduct state inspections of facilities. Elder Affairs officials had initiated attempts to shut down Lakeview Lodge, but backed off and eventually agreed to recertify the home.

In his recent letter to Vilsack, Sanvig says he offered to again work as an inspector for the state. The inspections department turned him down, he said.
