62 By DEBORA WILEY Of Tiik Rw hstkk's Ckiiak Rm'ii is Hi ukai Cedar Rapids, la. The man accused of murdering his ex-girlfriend as she delivered mail along her Cedar Rapids postal route in January will be tried by a federal judge instead of a jury. In an unusual move, Ronald Downs 51, asked U.S. Judge Michael Melloy on Tuesday to waive his right to a trial by jury. Downs' attorney, John Lane of Cedar Rapids, also withdrew his earlier notice of an insanity defense.

The burden of proving insanity rests with the defense, but Lane said he would not present any expert testimony regarding Down's medical competency. A psychiatric report from the Federal Medical Center in Springfield, earlier found Downs competent to stand trial. The case was set to begin Monday in Fort Dodge but will be held instead in Cedar Rapids. Melloy earlier had agreed to move the trial because of prejudicial and extensive pre-trial publicity that could have influenced a jury pool from the Cedar Rapids area. Neither Lane nor Assistant U.S.

Attorney Robert Teig would comment on the case Tuesday. Downs, a former postal worker, is charged in the shooting death of Gloria Heising, 40, of Mount Vernon on Jan. 20 outside of Downs' son's home. Authorities allege that Downs mailed a certified letter to that address along her route so he could lie in wait until Heising delivered it for a signature. No one else was home about 1:30 p.m.

when the letter was delivered, but the murder was witnessed by television anchorman Bob Hilton as he drove by chance down that street. Heising allegedly ran to the street and pleaded for mercy before the gunman shot her two or three times with a sawed-off shotgun, twice reloading. She was shot at least two more times with a handgun. Downs in 1992 was given a suspended sentence for harassing Heising, with whom he had an on-again, off-again relationship for several years. Among the points of contention yet to be argued by attorneys is a confession Downs made to a police detective and a postal inspector after his arrest.

The murder trial is being held in federal court since Heising was shot while delivering mail. Clinton taps Iowan for judgeship By KAREN HSU Whitkk President Clinton nominated Mark W. Bennett Tuesday for a vacant U.S. district judge position in the northern district of Iowa. Bennett, who currently serves as a U.S.

magistrate judge for the southern district of Iowa, will replace U.S. District Judge Donald O'Brien of Sioux City, if confirmed by the Senate. In May, U.S. Sen. Tom Harkin recommended four people for the Iowa position.

After Tuesday's announcement from the White House, Harkin representatives said the Senate Judiciary Committee will have three weeks to review the recommendation and set a hearing. After the hearing, the full Senate will vote on Bennett's nomination. Harkin representatives said Harkin hopes to have the Senate vote on the nomination by Aug. 15, when Congress takes a recess. Bennett graduated cum laude from Gustavus Adolphus College and received his law degree from Drake University in 1975.

Before being appointed as a U.S. magistrate judge in 1991, he was a member of the Babich, Bennett Nickerson firm in Des Moines for 16 years, specializing in civil rights law with an emphasis on employment discrimination. He also served as general counsel of the Iowa Civil Liberties Union, and has worked on three U.S. Supreme Court decisions. Bennett teaches as an adjunct professor at Drake University Law School and has taught as a lecturer at the University of Iowa College of Law.

In 1985, Bennett won a ruling that commencement prayers violated the U.S. Constitution. Luther study m.NiwsSii(in: Decorah, la.
