U.S. District Judge Sidney Arono-vitz held Grumman the manufacturer of the A-6 attack plane, responsible for the crash that killed Lt.

j.g. Gary Scott Shaw of Fort Lauderdale and another man on Dec. 12, 1979. Aronovitz based his decision on testimony by Lt. Cmdr.

John Shork, who was an eyewitness to the crash and assistant maintenance officer aboard the USS Constellation at the time. In the opinion, Aronovitz wrote that the plane "pitched violently and suddenly" into the ocean about 100 miles off San Diego within 2 or 3sec-onds after it was catapulted from the Constellation flight deck. The bodies of Shaw, then 27, and his navigator-bombadier, identified in court papers only as Lt. Bates, were not recovered, nor was the plane. The suit against Grumman was filed by the pilot's father, Edwin Shaw of Miami, on behalf of his son's estate, his son's 6-year-old daughter Kelly and his son's widow, Mrs.

Ma-jorie Shaw Daugherty, now married to another Navy flier in Oak Harbor, Wash. In addition to the damages, Aronovitz granted the Shaws the cost of their suit and expressly ruled that the award will not be reduced by the amount of federal benefits the family has received. Grumman had asked the court to subtract federal benefits if an award was granted. Earl Hutto predicted yesterday.

A Senate appropriations subcommittee removed the overhaul from its version of a military funding bill. A senior Navy officer has said the Lexington, the Navy's only carrier devoted exclusively to pilot training, would have to be pulled from service in a year without the overhaul. It would be a major blow to Pensacola's economy because the ship has a $30 million annual payroll. "The House Defense Appropriations subcommittee will meet to put the final revisions in the (House) bill tomorrow and I have asked them to restore the $127 million funding that was approved by both the House and the Senate armed services committees for authorization," Hutto said in a statement released by his Washington office. Hutto, whose district includes Pen-sacola, said that, at a minimum, the 5-PIECE DINING GROUP AT $140 OFF matching chair 249.95 coffee table 169,95 PEEL CANE DEWXESOFA $54995 AqLAL.

Meanwhile, the Navy has classified the Lexington overhaul as "a top priority" in documents submitted to Navy Secretary John Lehman as the basis for a forthcoming letter to members of the full Senate Appropriations Committee. Sen. Lawton Chiles who sought the letter, said he will ask the committee, on which he serves, to approve the $83.3 million minimum request. The panel hasn't scheduled a meeting on the issue. The Lexington is tentatively scheduled to leave 15 for Philadelphia where the overhaul would take place.

It would take 10 months for the full M27 million version and eight months for the scaled-down overhaul. Gov. Bob Graham earlier this met with Chiles and Sen. John jtennis also a member of committee, to urge support for he overhaul. Graham became aware )f the problem during a recent 'workday" aboard the Lexington.
