(PHMembers of the senate judiciary committee, now charged with determining what constitutes an intoxicating beverage in connection with the house beer bill, have a good legal precedent for asking Chairman Norris to let them make personal experiments. While waiting today for a quorum of the committee to materialize, Norris told his colleagues of an experience he had when he was a state judge in Nebraska and a member of his jury asked for a taste of the evidence in a liquor case to determine whether it was intoxicating. One case of the liquor seized was in court, Norris said, and long arguments over the question of whether it was intoxicating had been made by opposing counsel. Finally an Irishman in the back of the jury box, shouted up: Tries It Out. "Your honor, can we try that out Counsel objected, Norris said, but he ordered a bottle of the beverage which was labelled "hot tea" passed around to the jury.

Some of the jurors only sniffed, some refused even to do that, but the Irishman took a big drink. A little later, evidence was introduced that another case had been seized, the Irishman spoke up again and asked for a taste of that. Norris ordered the second case brought into court and directed that a bottle be passed to the jury. The same procedure followed, and this time the Irishman took a long drink, almost finishing the bottle. Compromise Verdict.

After deliberating all night, the jury finally brought out compromise verdict. The next day the Irishman met Judge Norris on the street. He was indignant because the town thought he had held out for acquittal. "I know beer," he told Norris. "I used to be a bartender and I know that was real beer.

I wasn't sure after the first drink because it was warm and I thought I might not be able to judge by that, so I asked for the other case. It was cold, and when I tasted knew that man was guilty." Norris said he was willing to follow that precedent in the present case if the committee desired, but added laughingly: Await Warm Weather. "If you want me to taste it, you will have to wait for warm weather to return." Senator Ashurst suggested that the only way to tell whether a beverage is intoxicating is to take a group of average men, fill their stomachs with the beverage, and watch the effect. Senator Blaine suggested there is often a confusion of the terms "exhilarated" and "intoxicated." He said the constitution prohibits intoxicating beverages which he contended did not include those that are merely exhilarating. Portland Sunday School Program Heard by Many PORTLAND, Dec.

Christmas program of the Portland Sunday school was held at the hall Thursday evening and was attended by a large crowd, filling the building to its capacity.
