McJIantma, mother of Miss Hat-tie McManima, teacher in the Third Ward Schools, died at Dexter at noon yesterday, after a short but severe illness. Yanderbilt's fast train made better time on the St. Kansas City Council Bluffs road than It did on the Northwestern 47 miles an hour. The trials of the saloon-keepers for failing to have their names over their doors, as required by the city ordinances, are still before the District Court. A shot-si stolen from a squatter on the bank of the classic Coon, a niileor so west of the Water Works, by some boys, was yesterday found buried in the sand where the boys had cached it.

Charley Kickett. who was assaulted by Mike Madigan, on Court Avenue, Friday, is still routined to his bed and unable to appear in Court. Madigan's trial has been postoned until such time as Kickett shall be able to attend. Yesterday morning a farmer living about twenty miles from Des Moines found three of his horses in our city pound, just ready to be sold by Marshal's sale. It cost him nineteen dollars to redeem them, but ha was very well pleased for all that.

mm ws tnlldlnss Torn Down The Shelby County Cases. The proceeding against homestead sqnat- ters, so-called, in Audubon county, has excited some remark and so much attention that for the benefit of our readers we have endeavored to obtain, and believe we are able to furnish the substance of the facts. We glean them from an Interview of the attorneys In the case. The controversy Is an old one, dating back to 1872, when som8 parties, encouraged therein by the suggestions of one who pretended to know, conceived the Idea that certain lands claimed by the R. T.

R. R. Co. were not really railroad lands, but, in fact, government lands, and subject to homestead entry. Forthwith they settled on such pieces as they selected, and some of them applied to the United States Land Ofliee" for certificates.

These applications were refused by the local land officers, test cases were appealed to the Commissioner of the General Land Ofliee, and from there to the Secretary of the Interior (then the present Senator Chandler), and the decision of the local office sustained. In the meanwhile, actions were commenced by grantees of the company in the State and Federal Courts to test the title, and in both courts the railroad title was sustained. In these cases the settlers submitted to the decisions of the court. Others, however, persisted, and iu 1S76 and 1877 they commenced actions against all they could find claiming possession. Many of these cases were stoutly contested before Judges Reed and Lou f-bourrow, the decisions being again against the homestead claimants.

Some of these were appealed, and are now pending in the Supreme Court of the State. In 1877, late in the year, the company built branch roads into the body of the land grant, and sought to sell lands. In this it is claimed they are obstructed both by the active discouragement of the settlers and by the fact that they were in possession of lands and not interfered with by the company. In some instances lands were sold, and this spring, a sale having been made, the purchaser went into possession, only to be ejected by a homesteader who claimed the land. This, it seems, led the railroad com pany to conclude thatforliearanee had ceased to be a virtue.

Writs of ejectment were therefore issued under the judgments already obtained, and the Sheriff directed to serve them. This he proceeded to do, and on Thursday last ejected two and on Friday another removing the families and their possessions from the land, and destroying, by direction of the couipauy, the houses and other buildings. As a result, some claimants have already bought their and others are negotiating. Th: company has adopted the plan of iestmying buildings to make the disposses sion complete and effectual. We are advised they ill follow the matter up until the list gone through fully.

There are some fif teen or twenty yet remaining in Audubon county, and perhaps as many in Shelby county.
