McKee Funeral Home is handling arrangements. Girls to live with dad who killed mom CUSTODY Continued from Page IM Violence. She said witnessing violence can have long-term detrimental psychological effects on children. In the ruling, the justices found that Lutgen had paid his debt to society and "is a fit and proper person" to have custody of the girls. The Tranels' lawyer, Gary McKenrick of Davenport, said further legal options, including an appeal to the Illinois Supreme Court, were possible, but a decision hadn't been made.

In a telephone interview, Lutgen said he and his daughters were happy with the decision. They live in a mobile home near town. Lutgen is currently on seasonal layoff from his job. The girls attend an elementary school in East Dubuque. "I know that I'm a good parent," said Lutgen.

"Just because somebody does something wrong doesn't mean they should" lose custody of their children forever. "You have to learn to live and forget," he said. In court, Lutgen testified he strangled his wife after she began choking him in an argument over whether Lutgen could take the girls on an outing to go Christmas shopping and roller skating. The couple had marital problems. Carol Lutgen had filed for divorce that day and had asked for a protective order against Lutgen, but he apparently wasn't aware of those actions.

Lawyers debate racism charge against juror 10 of JUROR al Continued from Page IM should get a new trial because the cards were stacked against him at the outset of the trial. They say that the jury's foreman, Ayrlahn Johnson, is a member of Posse Comitatus, a racist right-wing organization. Johnson, who lives in Grimes, denied that he is a racist or that he belongs to the group.

Legal scholars at the Drake and University of Iowa law schools say a judge would have to consider several issues before throwing out the verdiets against Knox if the allegations against Johnson were true. Adams said the courts would readily get involved in "external" issues involving the jury process, in which a juror may be threatened or coerced into voting for the guilt or innocence of a defendant. But Adams said the courts are generally reluctant to involve themselves in "internal" matters, and juror biases would fall into that category. He said the reluctance prevents unwarranted claims against jurors by defense lawyers. What Questions Were Asked? Barbara Schwartz, a law professor at the University of Iowa, said the case may depend on what questions were asked of Johnson during jury selection.

"They have a good case if they asked jurors about memberships in organizations," Schwartz said. think any defense lawyer would have struck Johnson from the jury." But Schwartz said it would be difficult to dismiss a prospective juror if the person didn't provide lawyers with honest answers during questioning. "It was particularly important in the Knox case because of the issues and the parties involved," she said. Knox's lawyers contend that Johnson "intentionally omitted his racist attitudes" when prospective jurors were asked about memberships in organizations or anything that would prevent them from being fair to a black defendant. Different Kinds of Bias Adams said even if Johnson were a member of Posse Comitatus, "membership alone doesn't mean you believe in all the tenets of that organization." "People are biased in lots of different ways," he said.

Nickerson and Rosenberg said the allegations against Johnson are based on a sworn statement from a man who said Johnson tried to recruit himfor the group about eight times between 1985 and 1986.
