(54 & 56) IN THE DISTRICT COURT OF IOWA, IN AND FOR KOSSUTH COUNTY, PROBATE NO. 9033 NOTICE OF HEARING ON SALE OF REAL ESTATE IN THE MATTER OF THE ESTATE OF fflllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllll llllllllllllllllllllllllllll| OFFICIAL NOTICE OF SALE $165,000.00 Sentral Community School District Kossuth and Palo Alto Counties, Iowa School Building Bonds Sealed bids will be received by the undersigned Secretary of the Board of Directors of the Sentral Community School District, in the Counties of Kossuth and Palo Alto, State of Iowa, at her office in the Sentral Community School, located on County Highway A between the towns of Fenton and Lone Rock (P.O. Fenton), Iowa, until 12:00 o'clock Noon, Central Daylight Saving Time (11:00 o'clock A. M., Central Standard Time) on the 8th day of August, 1967, for $165,000.00 School Building Bonds of said School District, at which time they will be presented to the Board of Directors of said School District at its meeting to be then held at the Board of Education Office, at the aforementioned Sentral Community School. After the receipt of open bids, the sealed bids will be opened, and the bonds will be sold to the highest bidder for cash. Open bidding will be concluded not later than 12:30 o'clock P. M., Central Daylight Saving Time (11:30 o'clock A.M., Central Standard Time). Sealed bids will be fully protected. Said bonds will be of the denomination of $1,000.00 each, dated August 1, 1967, bear interest payable May 1, 1968, and semi-annually thereafter, and will mature in numerical order on November 1 of each of the respective years as follows: $ 5,000 1968 10,000 1969 10,000 1970 10,000 1971 10,000 1972 10,000 1973 10,000 1974 10,000 1975 30,000 1976 30,000 1977 30,000 1978 None of said bonds will be optional for redemption prior to maturity. Said bonds will be reglstrable as to principal only. Both principal and interest will be payable at the office of the Treasurer of said School District, Fenton, Iowa, Each bid must be for all of said bonds on the Official Bid Form, upon terms of not less than par and accrued interest. Bidders must specify a single rate of interest for the bonds, in a multiple of one-quarter (1/4) or one-tenth (1/10) of one per cent, and not to exceed four and one-half per cent (4 1/2%) per annum. Each installment of Interest will be represented by a single coupon on each bond. The bonds will be awarded to the best bidder determined upon the basis of the lowest coupon rate of interest. In the event of identical coupon rates, award will be made to the bidder offering the highest premium. These bonds are being issued pursuant to the provision of Chapter 296 of the Code of Iowa, 1966, and all taxable property in the School District will be subject to the levy of taxes sufficient to pay the principal of and the interest on said bonds without limitation as to rate. Delivery is expected within thirty days after the sale in Chicago, Illinois, or Des Moines, Iowa. Should delivery be delayed beyond 60 days from the date of sale for any reason except failure of performance of the successful bidder, then the bidder may cancel his agreement to purchase the bonds and receive back his check and thereafter his interest in and liability for the bonds will cease. The District will furnish the printed bonds and the unqualified approving opinion of Messrs. Chapman and Cutler, Attorneys, Chicago, Illinois, and all bids may be so conditioned. Said opinion, which will be printed on the bonds if requested by the purchaser, will recite that, based on current rulings and official interpretations, interest on said bonds is exempt from present federal income taxes. At the time of delivery the District will furnish the transcript of proceedings on which said opinion is based, including a certificate that no litigation is then pending affecting the boundaries of the District, validity of the bonds, or the right of the District to issue them. A certified check or cashier's check drawn on a solvent state or national bank for $5,000 payable to the order of the Treasurer of said School District must be furnished by bidders as a guarantee of good faith, this amount to be retained pending full performance by the successful bidder and to be forfeited to the District as agreed liquidated damages upon failure to take up and pay for the bonds when ready. The right is reserved to the Board of Directors to reject any or all bids and to waive any irregularities in any bid.
