Constable Belacic said the car's horn sounded as it passed him and disappeared around a bend. Constable Belacic said that when he came around the bend and stopped at the traffic lights at the intersection of Lorimer Street and the West Gate Freeway, he had been surprised that he could no longer see Mr Drake's car. He said he turned his car's lights on to high beam and saw Mr Drake's car smashed into the wall of a wharf. Sergeant Peter Townsend, of the Glen Waverley accident investigation section, told Mr Adams that there were several signs warning motorists to slow down on the last 600 metres of the West Gate Freeway.

The speed limit for this section was 60 kmh. Mr Adams said that Mr Drake's blood alcohol level bad been "more than twice the legal limit on Victorian He found that both deaths were due to the culpable driving of Mr Drake, and ordered him to appear before the County Court on 5 November. He granted bail on Mr Drake's own undertaking with no surety. Mr Frank Render, assisting the coroner, told the court that an analysis less than two hours after the accident gave a blood-alcohol reading of 0.131 per cent for Mr Drake. He said Mr Carboon's reading was 0.213 and Mr McKenzle's 0.127.

Mr Hender said the dead men had been guests at a Christmas party at Mr Drake's Yarraville home on 23 December. Most at the party has graduated from the academy two months earlier. Many of the police guests had seen Mr Drake drinking cans of beer between 11.30 pm and 3 am, Mr Hender said. Constable Andrew Belacic, of the Russell Street police station, told Mr Adams he had been one of the last to leave the party.
