SATURDAY, OCTOBER 16, ARIZONA REPUBLIC VALLEY STATE 2010 B7 Can a company competing for a contract handpick officials? emergency ambulance service in Scottsdale. In 2005, dropped fire service but hoped to keep the more lucrative ambulance contract for Southwest. Scottsdale instead put the service out to bid and selected Professional Medical Transport. In February, as PMT's fiveyear contract entered its final year, Southwest lobbied to reopen bidding. The City Council instead followed the fire chief's advice and extended PMT's contract by two years the first of three possible extensions.

Only Councilman Ron McCullagh voted no. That was that, until last week when Southwest Ambulance launched three independent campaigns aimed at getting Councilman Wayne Ecton re-elected along with challengers Linda Milhaven and Dennis Robbins. If Southwest succeeds, the trio will join McCullagh on the sevenmember council. Lest you think this is the usual $410 contribution people like you and I can offer a candidate, think again. Southwest is spending $28,749 on each of the three, for signs that are identical to the candidates' signs and for mailers that look and sound as if they come from the candidates, un- ROBERTS Continued from BI on "Classified place ad Deadline to Monday Saturday for next day's publication, day's publication.

Josh Weiss, a spokesman for Southwest Ambulance, wouldn't answer questions about why the company has suddenly gone into the election business. Instead, he released a two-sentence statement calling the campaigns "just another way for us to be involved in the community." And not just in 1 Scottsdale, as it turns out, but also in Chandler, which currently splits its ambulance service between Southwest and PMT. In the weeks leading up to the September election, Southwest spent more than $11,000 to get Chandler Councilman Jeff Weninger re-elected and nearly $16,000 to make sure that Trinity Donovan got another term. Both won.

Now, Southwest is in Scottsdale, spending a jaw -dropping $28,749 on each of its three favored candidates. That's more than two of the three had raised for their own campaigns as of June 30, according to their latest reports. None of the three could have stopped Southwest from essentially loading them onto company gurneys and racing them to the electoral finish line. But they aren't exactly decrying the corporation's giant helping hand either. Ex-ballplayer gets death sentence for 1999 killing me," said Ecton, whose selection is curious given his vote to extend PMT's contract. "It doesn't mean that I'm obliged to anyone." "If some people can run a campaign that says don't vote for me, why can't someone else run a campaign that says vote for me?" Milhaven said, referring to an independent committee that is opposing both her and Ecton. That committee, formed by Pottery Paradise owner Mike Fernandez, must disclose its finances next week.

"I'm happy about it in that it's a local business that's supporting me," Robbins said of Southwest's corporate campaign. "I think that's a good thing, and I'm hoping they're doing it for all the right reasons." None of the three would commit to recusing themselves when the ambulance contract comes up again, likely in February 2012, saying they would seek advice from the city attorney. So the question remains, can a corporation in search of a city contract worth millions handpick a near majority of that city's elected officials? And if it does, will the officials return the favor? Gomez was convicted of rape, kidnapping and murder in 2001, but his sentencing was delayed because of changes in how death sentences are imposed in Arizona. A new jury, convened in 2003, sentenced him to death. That verdict was thrown out by the Arizona Supreme Court in 2005 because the jury may have been influenced by seeing Gomez in shackles and leg irons. A third jury was convened late last month to consider whether he should be sentenced to death or to life in prison for the murder.

Gomez refused to attend the latest trial. Nonetheless, the jury found an aggravating factor of cruelty, which qualified him for the death penalty. Gomez appeared in court for the first time on Tuesday to make a statement, against the wishes of his attorneys. Speaking in Spanish, his words translated by an interpreter, he disputed the facts of the crime at length, though his guilt was decided years ago. He told the jury that he was convicted of murder because he is Black and Hispanic.

But he added bitterly and sarcastically, "Sammy Sosa is now suffering from Alzheimer's, and he no longer 1 remembers who Fabio Gomez is." In criminal trials, some evidence or testimony is excluded because it is highly prejudicial to the defendant. But that evidence can sometimes be introduced if the defense "opens the door" that is, refers to the material. After Gomez's speech, when the jury had left the courtroom, prosecutor Patricia Stevens asked the court's permission to introduce several witnesses to rebut Gomez's story. They included ex-girlfriends willing to talk about Gomez's unwanted advances to other women, about moments of brutality and prior arrests. Steinle limited what would be admitted, citing case law that says rebuttal should not be a "limitless attack on the defendant." "This trial has been done three times," Steinle said.
