Three for trial over explosives By FIONA ATHERSMITH, magistrate's court reporter Three men who were arrested last year after police raided a country property and allegedly found guns and explosives were committed yesterday to stand trial in the Sheppar-ton County Court. Mr Graeme Murphy, in the Seymour Magistrate's Court, sent the men for trial in the County Court sittings starting on 28 May.

They were each granted bail with a surety of $7000 and reporting conditions. Michael Patrick Thompson, 21, of Alexander Street, Clifton Hill, pleaded not guilty to possessing explosives for unlawful purposes, possessing explosives with intent to endanger life or property, and four charges involving firearms or explosives. Rodney Alan Stubbs, 37, of Ebden Street, Heathcote, pleaded not guilty to conduct endangering life or property, possessing explosives with intent to endanger life or property, and to four charges involving a firearm, explosives and the use of amphetamines. His brother, Peter James Stubbs, 36, of Reid Road, Strath Creek, reserved his plea on charges of possessing an explosive weapon for unlawful purposes, possessing explosives with intent to endanger life or property, and four charges involving a firearm, explosives, burglary and theft. In a statement handed to Mr Murphy, Senior Constable Darren Glee-son, of Seymour C1B, said police raided the 20-hectare property in Reid Road, Strath Creek, at 7 am on 3 October 1989.

Senior Constable Gleeson said that blankets were found on (he ground under a water tank, indicating that someone had been sleeping there, and on a wooden beam above these were two sticks of gelignite with fuses attached. A shotgun and rifle were found in a wooden shed. He said a clump of trees had been surrounded by logs and car wheels and appeared to have been arranged to conceal a person in a type of hide. He said he wanted the rich to "taste the harm" because he and his wife had suffered at the hands of doctors, lawyers and other authorities. By taking rich people's children into custody, the rich people could taste some suffering." Huseyin said that he had not intended to hurt the children and denied having poured petrol on them. Huseyin's counsel, Mr Abe Goldberg, QC, in a plea for leniency, produced reports from a number of doctors who had varied opinions about Huseyin's state of mind. Dr Kenneth Byrne said in court that Huseyin had a delusional paranoid disorder, and displayed conduct that was psychotic in that it was out of touch with reality. A forensic psychiatrist, Dr Allen Bartholomew, found no evidence of mental illness, and said Huseyin was the sort of person who would go after something with single-mindednpss if he wanted IL Dr Lester Walton, another forensic psychiatrist, said Huseyin was a disturbed man who might have a paranoid delusional disorder. Asked if he had anything to say, Huseyin questioned the jury's verdict.

He wanted to know if it had been imposed by authorities. He also questioned the extent of the children's injuries. Then he said: "Seventy-five years ago, 70,000 to 100,000 Australians went to Turkey and killed a lot of people. What I did at the child-care centre was a minor thing (nnd) should not be treated that seriously." By PETER GREGORY Seraffatin Huseyin was stressed and worried when he awoke in a tent outside Parliament House at 4.30 am on 9 May last year. The day before, his wife, Zehra, had been taken to a psychiatric hospital by police, after she threatened to burn herself to death during a hunger strike.

It was the fifth hunger strike the Huseyins had held, in an 11-year campaign for compensation after the birth of their son, Esin, in 1978. Esin, who had joined his parents in the Parliament House protest, was removed by police in March. After Esin's birth, the Huseyins had wanted two more children, but were told by doctors that it would be too dangerous for Mrs Huseyin to have another baby. Despite contrary medical and legal advice, they believed they were owed compensation for injuries allegedly inflicted on her. In his County Court trial last week, Seraffatin Huseyin said that on 9 May, he was worried about his family.

The court heard that he caught a train home to Springvale, gathered petrol, a tomahawk, matches, a hammer and other equipment, then travelled to Hawthorn, where he intended to visit a child-care centre. His purpose was to achieve publicity for his wife's compensation case. When he took four children hostage for seven hours at the Manresa kindergarten, crews of journalists, photographers and camera operators flocked to the scene. Huseyin said in evidence that he told the kindergarten director, Mrs Anne Cantwell, of his aims when he approached her at Manresa shortly before 10 am. "I told her that we had been on hunger strike I gave her a piece of paper.

I gave her phone numbers of TV stations and newspapers. I told her not to be scared. I also told her to notify the police," he said. Mrs Cantwell said that at 9.55 am she got up to meet a man at the front. He was agitated, with a determined A Oivtston on Swtnbume LtmHed Incorporated hi Victoria.

She said he pulled a gun out of his pocket and pointed it at her stomach. He told her he did not want to frighten anybody, but he wanted her to ring Channel 9.

He said: "They won't listen to me, but after this they will." After children weie taken into the kindergarten kitchen, Mrs Cantwell and two other women were sent out of the room. She ran across the road to a church to telephone the police. Her assistant, Mrs Gael Spelrs, and a mother, Mrs Gail Marshall, helped move most of the children out of the kitchen. Four of the four-year-olds, three boys and a girl, were taken by Huseyin to a staff toilet. According to the Crown case, Huseyin nailed the being met.

Inspector Geoffrey O'Loughlln told Huseyin that he was not a bad man or a criminal, but he was trying to right the injustices that had been done to him. "This is your day. People are watching. In the County Court, Judge Fricke sentenced Theodore George, 30, to 12 months' jail, but suspended six months of the term. He fined George $10,000 and disqualified him from driving for three years.

The other driver, Constantlnos Patronis, 21, was sentenced to eight months' jail, six months of which was also suspended. He was fined $5000 and disqualified from driving for three years. George, of Mill Avenue, Forest Hill, and Patronis, of Rosella Court, Wheelers Hill, were each convicted by a jury of one count of culpable driving on 5 November 1987. George was also convicted of failing to render assistance after the accident.
