Mesa, Peoria, Phoenix, Scottsdale and Tempe, and the Town of Gilbert, Arizona are responsible for implementing and operating industrial wastewater control programs in each of their communities.

Each program is designed to protect the wastewater treatment plants (P0TW), the safety of personnel operating the wastewater collection system and the environment from the adverse impact that may occur when toxic wastes are discharged into a wastewater system. Each municipality issues wastewater discharge permits to Industrial Users (Users) in their communities and are responsible for ensuring that they comply with respective local ordinances and federal regulations. In accordance with the Federal Clean Water Act and federal requirements contained in the public participation requirements of 40 CFR 25 in the enforcement of National Pretreatment Standards and defined by 40 CFR 403.8(f)2(vii), the Cities of Glendale, Mesa. Peoria, Phoenix, Scottsdale and Tempe, and the Town of Gilbert. Arizona are hereby publishing the following list of Users In Significant Noncompliance (SNC) with applicable pretreatment requirements.

A User is in a state of SNC when violations meet one or more of the following criteria: (A) Chronic violations of wastewater discharge limits, are those in which sixty-six percent or more of all of the measurements taken during a six-month period exceed (by any magnitude) the daily maximum limit or the average limit for the same pollutant parameter; (B) Technical Review Criteria (TRC) violations, are those in which thirty-three percent or more of all of the measurements for each pollutant parameter taken during a six-month period equal or exceed the product of the daily maximum limit or the average limit multiplied by the applicable for BOD, TSS, fats, oil and grease, and 1.2 for all other pollutants except pH); (C) Any other violation of a pretreatment effluent limit (daily maximum or longer-term average) that the municipality determines has caused, alone or in combination with other discharges, interference or pass through (including endangering the health of POTW personnel or the general public); (D) Any discharge of a pollutant that has caused imminent endangerment to human health, welfare or to the environment or has resulted in the POTW's exercise of its emergency authority to halt or prevent such a discharge; (E) Failure to meet, within 90 days after the schedule date, a compliance schedule milestone contained in a permit or enforcement order for starting construction, completing construction, or attaining final compliance; (F) Failure to provide, within 30 days after the due date, required reports such as baseline monitoring reports, 90-day compliance reports, periodic self-monitoring reports, and reports on compliance with compliance schedules; (G) Failure to accurately report noncompliance; or (H) Any other violation or group of violations which the municipality determines will adversely affect the operation or implementation of the local pretreatment program. This notice covers the period from January 1, 1997 through December 31, 1997. The following list identifies the name and address of the User. This, in turn, is accompanied by six columns of information pertaining to violations and enforcement actions. The "Nature of ViolationType of Pollutant" column identifies what kind of pretreatment violation was committed andor the name of the pollutant (e.g., copper, lead, nickel, zinc, etc.) that was improperly discharged into the sewer.

The "Date of Last Noncompliance" is the last date that the User has violated pretreatment requirements for the listed violation during the reporting period. The compliance status on the last day of the reporting period is located in the column labeled "Has User Returned to Compliance as of December 31. 1997?" This makes the eleventh consecutive year in which Users significantly violating industrial pretreatment requirements have been published in the newspaper. The "Number of Times Published" column identifies those Users appearing below that have been listed in any of the prior newspaper publications. For example, a User published for the first time will have the number 1 in this column.

If a User made the list every published year, the number 1 1" is in this column. The enforcement tools available to a municipality for pretreatment violations includes a Notice of Violation (NOV), issuance of an Administrative Order (AO), the seeking of monetary penalties, andor termination of sewer service. The type of enforcement action taken is briefly described in "Nature of Enforcement Action." The "Comments" column summarizes information associated with the enforcement action. Public participation and cooperation are important to a successful pretreatment program. If you witness a situation that you believe may involve an illegal discharge of pollutants or hazardous materials into a municipality's sewerage system, please immediately notify the appropriate municipality: Gilbert (497-9191).
