Schulze, meanwhile, made two more trips to California over Rand's objections, but with the judge's permission. At the urging of the heartbroken Maher family, the judge did at least order Schulze to be monitored by the court's Pretrial Services Agency, taking drug tests three times a week and checking in weekly by phone. It was, at least, an attempt to keep track of Schulze, and it worked for awhile. Three weeks after the bond hearing, O'Hair-Schattenberg had a change of heart. She returned to court to request a change in the conditions of Schulze's release. Her office had finally figured out that Schulze had no real ties to the Valley a key consideration in predicting whether someone is likely to flees But Kazan, objected, saying O'Hair-Schattenberg had shown no real concern about getting his client into custody before.

She'd even agreed that Schulze could go visit her parents in California, and she hadn't even accepted an address and phone number where Schulze could be reached when it was offered. Nothing had changed, Kazan said, so why force her to post bail now? The judge, Barbara Jarrett, agreed with Kazan. Within a few weeks, O'Hair-Schattenberg was taken off the case, and a short time later, she resigned to become a Tempe municipal judge. She declined, through a city court spokesman, to discuss the case, saying it would be inappropriate for a judge to comment on an ongoing investigation. However, Bill FitzGerald, a spokesman for the county attorney's office, defended her handling of the case.

He said his office sought a bond as soon as people there realized Schulze had weak ties to the community, and that they didn't go after her driver's license because they were out to convict her of manslaughter. As for an arrest that first night, FitzGerald said that wasn't O'Hair-Schattenberg 's call to make. "The police agency has to make that determination themselves because they're the ones doing the investigation," he said. Scottsdale's Sgt. Mike Anderson said it's not that simple.

"We work with them and come up with a decision jointly to benefit the public," he said. The Schulze case slogged on through the justice system in late 1994 and 1995. Once they noticed the first one or two misses, they still wouldn't have notified the judge or prosecutor, Mitchell said, because Schulze had complied with court-ordered testing for a year. That is little solace to Rose Marie Maher, who this week begins her fourth year of living without her daughter, knowing that the woman responsible for her daughter's death remains free and that nobody is doing much of anything about it. "She killed my daughter, but she really destroyed our home," she said.

"We had a home full of love and laughter. It's now full of tears and grief. She didn't just kill my daughter. She took everything, and it's too bad. They just let her walk away." No one in the court system has an answer for Maher.

The case, they say, was treated as any other like it. This one just got away. For his part, FitzGerald believes Schulze will be captured someday. "She has a warrant out for her arrest," he said. "She will have to be looking over her shoulder for the rest of her life." Maybe he's right.
