The Perpetusl Trustee Company (Limited), ss executor of the will of the iste John Richard Hall, formerly of Mew-castle, merchant, appealed from a decision of the New South Wales State Pull Court, on a stated case. In 1911, Hall (the settlor) transferred certain shares in a limited liability company to trustees, who became the registered holders of the shares, ot whom be himself was one, upon trust to apply the Income or corpus for the maintenance and benefit of Hall's son during minority, and to transfer the property absolutely to the son on his majority. The settlor, with his ro-truatecs, received and applied for the son's benefit the dividends paid in respect of the shares.

The settlor died in June. 1921. and his son attained his msjority In November. 1931. The Commissioner for Stamp Duties claimed that the shsres formed part of the deceased settlor's estate for the purpose of assessment and payment of death duty.

This clslm was contested by the settlor's executor, at whose request the Commissioner stnted a case for the opinion of the Court.
