Child-agency workers given lawsuit shield By Pamela Manson The Arizona Republic Child Protective Services cannot be sued under a federal civil-rights law for their actions in trying to take custody of a child, the Arizona Court of Appeals ruled Thursday. The court said the state agency's caseworkers have "absolute immunity" in the initiation and filing of a petition for the state to take custody of a child in a suspected abuse case. The ruling also said that caseworkers have a "qualified immunity" under federal law for their actions leading to the initiation of the petition. Caseworkers are protected from liability in civil lawsuits if their conduct does not violate a right that a reasonable person would have known about, the ruling said.

The court said the caseworkers can be sued under Arizona law, which requires the plaintiffs to prove that caseworkers acted with malice. "The caseworker must act quickly, often with incomplete information in a hostile environment," Judge Joe Contreras wrote for the court. The case involves James Nation, who died in January 1985 at the age of months. According to court records, the boy was placed in a hospital in December 1984 with a broken leg. Because the injury was unexplained, a doctor contacted Child Protective Services, a division of the Arizona Department of Economic Security.

A week after the baby went into the hospital, caseworker Michelle Colla filed a petition for the state to take temporary custody of him. The boy was placed at the Mesa Crisis Nursery. On Jan. 4, 1985, James was found not breathing in his crib at the nursery. The medical examiner stated that the cause of death was sudden infant death syndrome.

The baby's parents, Sheryll and Jeffrey Nation, sued Colla and the department, charging negligence. A jury awarded the couple $90,000. Colla appealed on immunity grounds. Jeffrey Nation committed suicide last year. Friends said he was despondent over personal problems, including the death of his son.

Robert Hommel, an attorney for Sheryll Nation, said he probably will appeal the Appeals Court decision to the Arizona Supreme Court. Knapp confessed, former in-law says By Pamela Manson The Arizona Republic The former mother-in-law of John Henry Knapp has testified that a friend told her in 1973 that Knapp had admitted killing his two daughters. Louise Stamey, 56, of Pedley, said Wednesday that she discounted the alleged confession by Knapp because she thought her friend was joking. The friend, Melba Powers, was angry and "used to say things she didn't mean," Stamey said. Knapp is being tried in Maricopa County Superior Court on two counts of first-degree murder in the 1973 deaths of his daughters Linda Louise, 3, and Iona Marie, 2 in a fire at the family's house east of Mesa.

His first trial on the charges ended in a mistrial in 1974. Knapp was convicted in a second trial that year and sentenced to death. His conviction was overturned in 1987, when a judge agreed with defense claims that the girls might have set the fire accidentally. Murder charges were refiled against him last year. Powers testified Tuesday that Knapp had told her he killed his daughters.

Under questioning by a defense attorney, she acknowledged that there is no record that she ever mentioned the alleged confession during four 1974 interviews with investigators and prosecutors, or during the first two trials. Stamey, whose daughter, Linda, was married to Knapp at the time of the fire, said Wednesday that she passed on the statements to the prosecutor at the 1974 trials. She never was asked about it when she testified at those trials, she said. Stamey also said that Knapp showed emotion only once over his daughters' deaths. Her son-in-law started crying a few days after the fire when he saw newly developed pictures of the girls taken before their deaths, she said.

Prosecutors have characterized Knapp as cold and unemotional over the loss of his daughters. Billy Vaughn, big-band musician The Associated Press ESCONDIDO, Calif.
