John S. Battle for a pardon from a seven- year prison sentence imposed on. the ex-convict yesterday. Kelly pleaded guilty circuit court to a charge of maliciously shooting a Virginia state trooper while fleeing from a Burlington, N. C.

robbery in December, 1938. Kelly was taken to the Virginia State Prison at Richmond for safekeeping the pardon request is prepared. Circuit Judge John hooper refused a request that Kelly, be freed for 60-days to allow for the pardon application, and he also refused to give Kelly a week in which to get his Tar Heel affairs order. Thomas, now a captain of Virginia State.Police, testified Kelly fired on him just after crossing the Virginia line after he had driven Kelly car into ditch. Thomas was struck in the left shoulder Kelly then fled but was' later apprehended and taken back to North Carolina, where he served a 12- year sentence for his part in the robbery.
