UK' THE SECRET POLICE FILES By investigative reporters GARY HUGHES and GERARD RYLE OmbiidsmEii misled om toiumniiinig of papers Police special branch files obtained by The Age appear to have been removed and hidden sometime after they were earmarked for destruction. About 9200 special branch files were vetted by a former Supreme Court judge, Justice Nelson, QC, in 1983, who decid-ed that 8370 should be destroyed. According to a later, 1989, ombudsman's inquiry into the fate of the files, those destined for destruction had the relevant index card stapled to each file. The original files obtained by The Age still have those cards stapled to their front covers. The person who conducted the 1989 inquiry, the former ombudsman, Mr Norman Geschke, said it now appeared he was misled.

He said the files obtained by The Age were "clearly in that category" that should have been destroyed. "I appear to have been misled by the police over the destruc- tion of the files," he said. "Clearly, this is a case where the police said a file didn't exist when it did. "1 have to accept that files existed that shouldn't have and were conceivably moved (in 1989) to avoid me finding them. "It is a conspiracy to defeat the ombudsman's Investigation if that is what happened.

It is very, very serious there has to be a proper inquiry into the matter because the credibility of the police force and a number of the officers is at stake." Special branch files earmarked for destruction in 1983 were supposed to have been burnt at the Harbor Trust incinerator in Port Melbourne. The final load of files was reportedly taken to the incinerator on 18 August 1983. According to official records, files were not destroyed individually, rather whole boxes of files went into the incinerator unopened, Mr Justice Nelson told the State Government on 29 August 1983. that he had satisfactorily overseen the destruction of the files. A total of 918 files were allowed to be retained, either because they related to people or groups linked to violence, or because they were subject to freedom of information requests.

The Age has been able to establish that three of the files it has obtained were the subject of Fol requests in 1983. One person who made the request was told by the Victoria Police the file had been "inadvertently Another was told her file could not be located, and a third was told his file did not exist. During the 1989 ombudsman's inquiry, investigators interviewed former special branch police and senior officers involved in the destruction of the files, who told them that to the best of their knowledge none had been improperly kept. In his report to Parliament in March 1990, Mr Geschke said he was "reasonably satisfied" that there was "reasonable care taken to ensure that only those files authorised by Justice Nelson were in fact transferred and that this transfer was in nccor- dance with Government as to what records I le said he had been "number of assurances" original files and index were destroyed along authorised photocopies.

Yesterday, however, he was able to leaf through the file he had been told did not exist after he lodged a freedom of information application. Other special branch files obtained by The Age include those of a Communist Party member, Ms Valeric Tattam, who has since died, and the late Mr Kenneth Coldicutt. Mr Coldicutt's file was started in August 1981 when he wrote a letter to The Age in his capacity as a member of the Committee for Abolition of Political Police. Mr Coldicutt was also the co-author, along witli former state Labor politician Ms Joan Coxscdge and Mr Gerry Har-ant, of the book Rooted in Secrecy. SECRE1 Group hike through bush watched by agent m. ml fisN mm It came as no surprise to the university lecturer Tony Dalton that his activities as a Vietnam War conscription dodger and peace protester during the 1970s earned him a Victoria Police special branch file.

What surprised him when The Age handed him a copy of his file was that it still existed after the Labor State Government ordered all such dossiers destroyed in 1983. He was also surprised by the sheer size of his dossier, which runs to 125 pages and includes surveillance reports on the activities of his parents and brother. "I guess we always knew that police were taking an interest, but the level of effort is just absolutely extraordinary. "The numbers of people they had sitting in courts, the numbers of people they had attending meetings, attending demon- strations, standing outside meeting halls, writing down car registrations and describing people's appearances it's overwhelming." One report in his file details how the headmaster of the high school attended by Mr Dalton's brother called in the special branch in 1968 after "subversive" left-wing pamphlets were circulated among students. Many of the pages in the file are stamped "secret" and cover Mr Dalton's jailing in 1969 for refusing to register for conscription and his activities as an antiwar protester.

There are surveillance photographs of him attending demonstrations. But Mr Dalton, 49, of North Carlton, the only way to uncover when the files were kept agiiinst government orders and why people were wrongly told they had been destroyed or never existed. Mr Sennett's file contains special branch intelligence reports detailing his activities as an anti-nuclear war protester in the early lS)7()s and anti-uranium mining demonstrator as late as 1982. One report from a covert special branch operative describes a Communist Party fund-raising barbecue and bushwalk by the Bed Ramblers bushwalkin'g club, which Mr Sennett attended on 21 November 1979. The undercover operative describes how he recorded the registration numbers of cars at the barbecue and later how he shadowed "at an even distance" the Ited Ramblers as they hiked five kilometres through the bush near I.ilytlale.

Mr Sennett says the discover)' that he was followed and secretly photographed over a decade was no surprise. "We knew we were continuously being watched and photographed," he said. Sitting in William Sennett's Victoria Police special branch file is the freedom of information request he lodged on 20 July 1983 seeking a copy of his dossier. The letter is stamped "Not recorded CIB special branch The stamp is dated 1 August 1983 and is signed by a detective inspector who was then head of the special branch. When Mr Sennett did not get a reply to his request, he telephoned the then Victoria Police Fol officer and was told his file was "away in another He told the officer he was worried it might be destroyed before he saw it and was assured that that would not happen.

Several months later Mr Sennett was sent a formal reply from the Victoria Police to his Fol application, apologising and notifying him that his file had been "inadvertently Mr Sennett's special branch file, number T243, is one of those that has been obtained by The Age which prove for the first time that such dossiers were not destroyed in 1983, despite instructions from the Labor State Government. Mr Sennett's who is a senior lecturer in public policy at RMIT, said he found it extraordinary that the special branch continued monitoring his activities after the end of conscription. "I even noticed that they had press clippings of my involvement in public housing policy debates," he said. Mr Dalton said an inquiry was the only option now to uncover why files were not destroyed in 1983. "We need an inquiry into how a police force deceived and disobeyed a democratically elected Government," he said.

"To pretend they weren't doing it, that they had stopped doing it and they had destroyed the files is outrageous. I always assumed I had a file, but I had faith in the process and assumed it had been destroyed." Under surveillance: In his dossier, there was a photograph of William Sennett leaving a friend's home in Middle Park. Fol request also specifically asks for all copies and negatives of any photographs taken on him by police. On his file is a surveillance photograph which Mr Sennett now says appears to have been taken when he was leaving a friend's house in Middle Park some time in the late 1970s or early 1980s. In 1983 the then Victorian ombudsman, Mr Norman Geschke, conducted an inquiry into complaints from people who had been told their special branch files had been destroyed after they lodged Fol applica tions.

After being shown Mr Sennett's file and the Fol request by The Age, Mr Geschke now says he believes he was misled when he was told by police that such files had been inadvertently destroyed.
