Earlier this month, the company announced that It would proceed with a $100 million float of Cochlear, which leads the world in bionic ear implant technology. PacDun is buying back 10 per cent of the group's issued share capital.

The buy-back was about 80 per cent complete, Mr McDonald said. PacDun shares closed steady at $3.24 yesterday. At that price the buy-back would swallow up more than $350 million of the company's funds. Mr McDonald said the company was focusing its attention on its high-tech rubber products business aimed at the domestic and Asian markets. PacDun has been under pressure from legal problems associated with its United States-based pacemaker subsidiary, Telectronics.

Problems with the pacemakers' leads have allegedly caused two deaths and 18 injuries, and analysts fear the prospect of massive damages payouts from the. 153 lawsuits that have so far been filed in North America against the company. Despite a sharp profit fall for the year, the mining giant North Ltd told shareholders yesterday the result was better than expected. Reduced financing costs and an improved performance of its business interests were given as reasons for the result. Speaking at North's annual meeting, the chairman, Dr Michael Deeley, said earnings from large capital investments made during the last financial year would start contributing to profits in about two years.

The investments, which were funded largely by the sale of North's interests in Pasminco and other minority investment interests, included the acquisition of a 25 per cent stake in the $1.02 billion Bajo de la Alumbrera mine in Argentina and the million acquisition of the Swedish Zinkgruvan mine. Dr Deeley said North would continue with plans to develop the new $170 million gold mine at Lake Cowal in New South Wales and also to evaluate the option to purchase 80 per cent of the Yakabindie nickel project. And he said the group would continue to expand its exploration program, with offices recently set up in Indonesia and Peru as well as those already in the United States, Chile and throughout Australia. The DPP has sought access to help in its prosecution of the former Coles Myer chief, Mr Brian Quinn, who has pleaded not guilty to defrauding the company over renovations to his former Templestowe home. Mr Merkel said there were diary entries that contained commercially sensitive, confidential and irrelevant material. He said counsel for Coles Myer, assisted by company officers who had inspected the diaries, could help the judge determine what was, or may be, relevant and what was irrelevant.

Justice Eames said the Crown, which had undertaken to use the diaries only for the case against Mr Quinn, should make that determination. He said the prosecution could make one copy of the diaries, and had undertaken not to make it available to people other than DPP officers preparing the case against Mr Quinn. When lustice Eames refused a Coles application to set aside a DPP subpoena seeking the diaries, Mr Merkel said the judge should rule against the Crown's bid for unfettered and unlimited access to the 9600 pages of diaries. He said lustice Eames should also sort out what was irrelevant and what the prosecution was entitled to inspect. He said the court had allowed a subpoena with a wide forum, and should act as a guardian to protect third parties.
