Tomlinson had asked Carboun to be quiet during the meeting. Collins had escorted Carboun from the council chambers to a hall outside, where Carboun was arrested. arguments produced some persona) skirmishing between Shaw and John Oberg of Phoenix, the lawyer for Collins and the city. Shaw said city officials violated Carboun's right of free speech and his right of freedom from unlawful arrest. He said the damages should include a $250,000 assessment against the city for personal and mental damages suffered by Carboun, $50,000 for violation of his rights and $100,000 for aggravation of Carboun's pre-existing physical ailments.

Another $20,000 should be assessed against Collins and $5,000 should come from Tomlinson, Shaw said. He told the jury that Carboun paid $5,108 for the defense of his criminal trial. Attorney Charles Muchmore of i Phoenix, representing Tomlinson, said in his closing that his client "in good faith" had tried only to restore 1 order at the council meeting. The meeting at which Carboun was arrested had drawn a large audience because of a vote on the strip annexation of the Williamson 1 Valley area northwest of Prescott. Carboun owned property in the area.

Incident at meeting in Prescott termed 'trampling' of rights By Fred Smith Yavapai County Bureau PRESCOTT Gus Carboun should be awarded more than $400,000 because of his arrest at a City Council meeting here four years ago, a U.S. District Court jury was told Tuesday. The damage figure was outlined in closing arguments by Carboun's attorney, Tony Shaw, who said, "We ask you to award enough damages to let every city and municipal official in the state know that they can't trample on the constitutional rights of individuals." The eight-member jury deliberated 45 minutes and will continue today. Carboun filed his lawsuit against the city and several city officials shortly after being acquitted of a disorderly-conduct charge brought against him when he was arrested at a Dec. 17, 1979, council meeting.

He had spoken at the meeting for about four minutes on an annexation proposal and was arrested after attempting to speak again. Before the closing arguments began, federal Judge Carl Muecke granted a defense motion to release former Mayor Jack Gillis from the suit. Uyeda's attorney, Ruben Teran of Sierra Vista, said "because Schissler has already attempted to run and has been legally denied a place on the ballot because of the court ruling, he is precluded from Lammers, who has been head of the department's highways division' since 1980, has helped "get the Papago Freeway project into high gear," Ordway said.
