The Arizona Republic E7 Friday, March 30, 1990 Kentucky to revamp schools, equalizing funding The New York Times The Kentucky General Assembly voted Thursday to abolish its system of financing and operating the state's 1,500 public schools, replacing it with an entirely new philosophy and structure of management. The lawmakers acted in response to a decision by the Kentucky Supreme Court in June declaring the state's school system unconstitutional be cause of inequalities in financing between rich and poor districts and because the overall performance of pupils has been inferior to that in other states. The court ruled that the state's formula for dispensing aid to schools was unconstitutional because of the difference in what the state's 178 districts spend for each pupil. That had run from $1,800 to $4,200 a year for the state's 570,000 pupils.

Under the new equalized funding plan, the minimum spending level for each pupil will be $2,900 in the 1990-91 school year. At the heart of the new system is a change in the role of the state Education Department, which will stop regulating textbooks, curriculums and other details of day-to-day school operations. Instead, it will manage an unusual system of rewards and penalties for schools and their staffs that will begin with the state's setting goals for academic performance, pupil health and attendance. The system also will be decentralized, with local districts gaining much control over the day-to-day operations and with individual schools gaining substantial autonomy. The plan is to begin in January and will be put into effect over five years.

Many details remain to be worked out, including the critical matter of how the state will measure whether schools are meeting goals. Schools that succeed will be given a free hand in personnel and curriculum and extra money for bonuses for teachers and staff members. Those that do not meet the standards face the possibility of state-involvement in the dismissal 'of individual teachers and the closing jpf schools. Carter, 65, former chief deputy UIIMUpHIM IWlJj .111.1 Ill fit i David E. Carter, who retired in 1988 as the chief deputy of the Maricopa County Sheriffs Office, has died at age 65. "He was very proud of his career," said his son, David Carter Jr. "He started as a deputy on the graveyard shift and worked his way up through the ranks until he was the top guy in the department, other than the elected sheriff." Deputy Carter died Wednesday in Del E. Webb Memorial Hospital in Sun City West.

He was born in Malvern, on July 30, 1924. A Marine Corps veteran of World War II, he began his nearly 32-year career with the Sheriffs Office in 1957. He graduated from the FBI Academy in Quantico, in 1962. The younger Carter son said his father received numerous citations from civic groups and commendations for his work with the Sheriffs Office, including the county's Distinguished Service Medal in December 1988. The marshals seized 136 videos believed to be illegal copies at All Star, according to the Motion Picture Association of America, a trade group. It said 116 videos were taken from Innes' house in Phoenix.

Also seized were 405 "master" videotapes that allegedly were used to produce the duplicates, 15 video recorders, nine TV sets and other electronic equipment, the group said. Innes denied any wrongdoing. He said his business deals in a high volume of videotapes and some shipments sent to him contained "problem tapes." Woman gets 4-year term in alcohoi-tied death A Glendale woman who struck and killed a 14-year-old Phoenix boy in an alcohol-related accident was sentenced Thursday to a four-year prison term for negligent homicide. Donna Rae Smith, 52, was sentenced by Judge Robert Hcrtzbcrg of Maricopa County Superior Court after jurors found her guilty March 1. Smith was charged in the death of Michael Tellcz, who was killed June 9 when he was hit by a van driven by the defendant while he was crossing North 43rd Avenue near his home.

After the accident, Smith was found to have a blood-alcohol level of 0.13 percent, which is higher than the 0.10 percent level at which Arizona motorists are legally intoxicated. Lester J. Maitland, an aviation pioneer who in 1927 became the first pilot to fly from the U.S. mainland to Hawaii, has died in Scottsdalc. He was 91. The former Army pilot, who also was an Episcopal priest, died Tuesday.

After serving in World War II, he left the military with the rank of brigadier general. As an Army pilot, Gen. Maitland and co-pilot and navigator Albert F. Hegenberger flew a three-engine Fok-ker from Oakland to Wheeler Field on Oahu in June 1927.
