Alfonso Saldanera, 36, of Poplar Street, Thomastown, told the court that he fired two shots into the creek to frighten the youths, who had been yelling filthy abuse at him, his friends and family. The Jury found Saldanera not guilty of having unlawfully and maliciously shot Peter Francis Stratton, 21, tram conductor. of Kitchener Street, West Brunswick, with intent to do grievous bodily harm. They also found him not guilty of a charge of unlawful wounding and of having negligently fired a rifle causing grievous bodily harm. Saldanera pleaded not guilty before Judge Norris.

Saldanera told the court a friend's property in Maand their familles a were at that he, his brother-in-law hony's Road, Fawkner, on Merri Creek. He and Frank Deballa, who lived on the property, SAW the four youths near some prickly pear, and Deballa told them to go because it was private property. Later they saw the youths near the creek playing M.L.A. Urges Commission on Oil Firms Appointment of a royal commission to investigate the activities of oil companies in Victoria WAS urged in the Legislative Assembly night by: Mr. White (C.P., Ballarat North).

Mr. White claimed that the companies were robbing the consumers and the people of Australia. This was proved by the tremendous profits they were making, he said, and the fact that the high price of petrol was having an inflationary effect on the economy of the transport Industry. He added: "The oll cornpanies are the real power In this country today and no one is game to tackle them. We should tell them that only Parliament Is supreme." Mr.

White accused the companies of pulling down homes "throughout the State" to make way for petrol stations. Even a church in Ballarat had been demolished to make way for a service station. In McArthur Street, three good homes were pulled down and a petrol station erected in their place despite the fact that there were already two other stations in the area, he added. Fitzroy Club Slander Case Now Settled A £10,000 slander action between the former secretary of the Fitzroy Football Club, John Patrick Buckley, and a committee member, ended the Supreme Court yesterday. In a statement the court announcing the settlement, Buckley and Maxwell Robert Sayer, the defendant.

said they wished to put an end to their differences and work together for Fitzroy. Buckley, of Barkley Street, East. Brunswick, had claimed that Sayer, at a committee meeting on January 5 last year, accused him of dishonesty which led his losing his job of I secretary. Mr. Nimmo (for Buckley) said Sayer, of Bell Street, Heidelberg West, denied he had uttered the slander and wanted to make it clear that he had always regarded Buckley as a man of integrity.

Mr. J. A. Nimmo, by Dall and Allaway, for Buckley; Mr. P.

A. Coldham, by Willan Miller for Sayer. Cable Job Nearly Over cable ship Matal, is expected to be back In service some time today. P.M.G. engineers are at present completing channel tests on the cable equipment.

With cricket out of the way and footpall still around the corner, Associated Grammar Schools will concentrate for a time on tennis, which is a much more 1m- portant sport in the A.G.S. than it 15 in the public schools. The four started to run away up the far bank, yelling Althy abuse and making "bad gestures" at him, his family and friends. When on the other side of the creek they moved back towards him and threatened to fight, insulting the women. He grabbed the rifle from his brother-in-law, Antonio for rabbits.

He only took it Ciancio, who was looking to frighten the youths because he himself was frightened. He shot twice into the creek and the youths were farther up the bank. Before he fired the first shot they were still abusing and coming his way. When he fired the other shot they were on the ground.
