ARIZONA NEWS BRIEFS 'Official English' case in court TUCSON A judge has taken under advisement a key motion in a case that challenges Arizona's "official English" amendment. The case involves Marciano E. Robles' attempt to reclaim his lunch wagon, which police confiscated in February when Robles was arrested for allegedly trafficking in stolen property. He pleaded guilty to attempted trafficking in stolen property and was sentenced to four years' probation. Robles filed a petition in Spanish seeking to have the state return his van.

But Deputy County Attorney Millard Rowlette argued that the petition was invalid because it was written in Spanish. Hector Estrada, Robles' attorney, argued that Robles' use of Spanish is protected by the U.S. Constitution. Charge is dismissed in Tucson beating death TUCSON A judge has dismissed a second-degree murder charge against a Tucson man because the prosecutor could not find an eyewitness to the slaying. Judge Lina Rodriguez of Pima County Superior Court dismissed the charge against Tommy Gene Jones, 19, "without prejudice," meaning it could be refiled, said Richard Nichols, a deputy county attorney. The judge had ordered the prosecution to make the witness available for an interview by defense attorney Glenda Edmonds by July 21, and dismissed the charge after the deadline was missed, Nichols said.

Jones was charged in the slaying of his mother's boyfriend, Edward "Ten-Speed" Means, 47, who was beaten to death with a pipe May 9. The case will be dismissed with prejudice, meaning the charges cannot be refiled, on Nov. 1 if the witness cannot be found, Nichols said.
