Merrl-wethcr, a colored dentist, 226b North Capitol avenue, who had brought suit for $10,000 damages against Gabriel aud Gotdio Slutzky, 2267 North Capllol avenue, and Mrs, C. Grooms, 2263 North Capitol avenue. Tho court awarded Merrlwethcr damages In tho sums of $160 from Mrs, Grooms and from the Hlut-ckys.

An Order was also issued by Jud-tc Moll directing the defendants to remove by noon tomorrow the "splto fence," parts of the wooden wall which extended more than Blx feet above tbo ground dividing the Merrlwethcr property from the Slut sky and Groom properties. The caso created considerable discussion last summer when the ques- xion oi preventing coiorou people irom moving up Capitol avenue, Invading the white residential section, and tho notion was brought by Dr. Merrlwothcr, July 1(, 1920, when the Capitol Avenue Protective Association Is said to havo conspired and agreed to back tho proposition of building "splto fences," and In other ways Bcek to discourage the colored people from moving Into that sec tion oi tno city. Violation Charged. A petition for a temporary Injunction was filed, along with tho suit for 000 judgment for damages.
